2019-07-16 PA UpdatePA’s Update July 16, 2019 2 p.m. Present: Commissioner Jackson, Commissioner Stamper, Commissioner Fund, Jonathan Meyer, County Manager Erik Martin, Cullen Gatten, Wayne Whiton, Janelle Kambich, Amber Caulfield, Sara Wibowo Guests: Alex Brown and various members of the public Recorder: Rieva Lester Jonathan Meyer discussed vacancies in his office. The board agreed to allow Jonathan Meyer to offer a job at a higher than a C. Jonathan said Jimmy O’Hagan has been identified as a vexatious litigant. Jonathan said there are no updates on Crystal Geyser. He urged the commissioners to refrain from making public comments on the matter and to refrain from adding it to future agendas until a time that the county involvement would be triggered. Commissioner Stamper asked if outside entities could create an injunction to block the project. Jonathan said discussions about the project may not rise to the level of meeting the requirements of an injunction. In response to Commissioner Stamper’s question, Jonathan said Lee Napier would be able to give details about what takes place at a Planning Commission workshop. Jonathan said he would share the Department of Ecology’s timeline for an application process. Amber Caulfield said the county is doing its due diligence regarding Water-Sewer District 5 and has found the following: • An Open Public Meetings Act (OPMA) lawsuit • Insurance lapse due to nonpayment • Non-payments to a CPA • Non-payments to Water-Sewer District 5’s attorneys • Liens filed in response to non-payments • Water-Sewer 5 may not have properly registered as a business and has not been paying taxes • Owe $4,000 for a state audit • Operational issues linked to a leak Amber said Water-Sewer District 5 has 25 water hookups and 8 to 10 sewer hookups. Amber said the Department of Health and the Department of Ecology could force a receivership, whereas the county is looking at transfer agreement right now. The commissioner said Erik Martin can be the point person on the commissioners’ behalf. Amber discussed hearings planned for Aug. 19 regarding the proposed dissolution of Davis Lake Drainage District No. 1 (Davis Lake, Morton) and Joint Diking and Drainage District No. 1 of Lewis and Thurston Counties (Hanaford Valley). Cullen Gatten said he is reviewing Tacoma Power’s draft agreement regarding CPI and finds it to be appropriate. He said the formula would apply retroactively to January 2018. Jonathan noted that the previously used CPI no longer exists. Cullen discussed a noise ordinance he has drafted. Cullen discussed a Blue Road property on which the county has a lien. He recommended waiving interest on the lien. The commissioners approved having Cullen waive the interest on the lien. At 2:31 p.m., Commissioner Jackson announced that the Board was going into Executive Session under RCW 42.30.110(1)(i) for 5 minutes to discuss potential litigation related to Restorical Research. At 2:36 p.m., the Board extended Executive Session for 1 minute. Executive Session ended at 2:37 p.m. Commissioner Jackson noted that no decisions had been made. Commissioner Stamper made a motion to submit a letter from Matt Cockrell to Great American Insurance for a potential global settlement. Commissioner Fund seconded. Motion passed 3-0. Meeting ended at 2:39 p.m.
