Meeting with DPA Eric Eisenberg

Eric Eisenberg said it appears the BOCC cannot dictate the
following:
• A timeline on how quickly the freeholders must
generate a charter
• A time limit on how long someone can serve as a
freeholder
Eric said elected freeholders must begin work on the charter
within 30 days. If passed, the charter itself must be
implemented within six months, he said.
For vacancies, Eric suggested the BOCC could nominate three qualified candidates and then the
freeholders from the district with the vacancy would choose the person to fill the position. In the event
of a tie, the commissioner of that district could cast the winning vote.
Regarding compensation, Eric said the BOCC could set a term during which some type of compensation
would be provided. He said it would merely need to be set in place before the election.
Commissioner Jackson said he feels a $25 filing fee may be too low. He suggested possibly setting a filing
fee of $75 or $100.
Eric further discussed stipends. He said the county could provide a monthly stipend of $200 (covering
dinner as well as mileage), which would total roughly $36,000. Another option, he said, would be a
mileage stipend triggered by length of travel (such as, “If you’re driving more than 15 miles, you’ll get
54.5 cents per mile”), which would total roughly $10,000. Commissioner Jackson floated a $50 flat rate
plus $15 for dinner ($65 total) for one month (which would total roughly $23,400 if there were two
meetings monthly).

Becky asked if freeholders would be considered an elected official for benefits purposes.

Eric suggested adopting the policy by resolution via a hearing in early April to give potential freeholders
plenty of notice prior to filing week.
