LEWIS COUNTY, WASHINGTON
IN THE MATTER OF: RESOLUTION NO. 20-097
THE PROPOSED ACQUISITION OF ADDITIONAL RIGHT
OF WAY FOR TOWNSEND ROAD BRIDGE
REPLACEMENT
WHEREAS, Resolution No. 20-049 instructed the County Road Engineer to acquire all
necessary right of way from two property owners on Townsend Road for the bridge
replacement project; and
WHEREAS, it has become necessary to acquire from one additional property owner;
and
WHEREAS, this bridge replacement is a necessary road improvement and will benefit
the public; and
WHEREAS, RCW 8.08.010 authorizes counties to acquire property when deemed
necessary by the Board of County Commissioners (BOCC); and
WHEREAS, pursuant to the requirements of RCW 8.08, this resolution instructs the
County Engineer to acquire right of way as shown on the attached exhibit from one
additional property owner along Townsend Road for the project.
NOW THEREFORE BE IT RESOLVED that the County Road Engineer is instructed to
acquire all necessary right of way and is authorized to sign documents necessary for
the bridge replacement project on Townsend Road in Section 22, Township 13 North,
Range 2 East, W.M.; and
NOW THEREFORE BE IT FURTHER RESOLVED that the BOCC directs that all such
acquisitions be in accordance with adopted procedures as per Resolution 17-336 and
under Lewis County's eminent domain authority, as per RCW 8.25 and WAC
458-61A-206 (ic), and pursuant to authority and obligations of RCW Title 8, notably
8.08, 8.25, and 8.26.

On February 10, 2020 the Board of County Commissioners (BOCC) instructed the County Road
Engineer to acquire all necessary right of way from two property owners on Townsend Road for the
bridge replacement project. It has now become necessary to acquire from one additional property
owner. RCW Chapter 8 authorizes Counties to acquire property when deemed necessary by the
BOCC. Pursuant to the requirements of RCW Chapter 8, this resolution instructs the County
Engineer to acquire right of way from one additional property owner along Townsend Road for the
project. All such acquisitions shall be in accordance with adopted procedures as per Resolution
17-336.
