Eric Eisenberg said there are two Office of Public Defense (OPD) reimbursement contracts Lewis County
has received for Blake-related defense costs. Eric said the debate is when each contract was eligible to
be used for reimbursement during specific periods of time. He is partnering with OPD to determine if
there is any overlapping in grant time period usage.
Andrew Logerwell asked if there were any questions or concerns about the District 3 Commissioner
replacement. He also said the Prosecuting Attorney’s Office is still in process of recruiting for a 4th civil
deputy prosecuting attorney position and at this time and that criminal trials are no longer stayed and
will resume.
At 2:06 p.m. Commissioner Pollock announced that the Board would be going into executive session for
15 minutes under RCW 42.30.110(1)(i) to discuss:
• Lewis County Water District No. 2 v. Lewis County
• Trans Alta litigation
• Blake litigations
• Jerrie O’Connor v. Lewis County
• Kyle Rohrig v. Lewis County
And to discuss two other matters under RCW 42.30.110(1)(h)
• Commissioner District 3 vacancy
• Fire District 4 vacancy (placeholder if needed)
Executive session started at 2:08 p.m. for 15 minutes.
At 2:23 p.m., the Board extended executive session for 5 minutes.
At 2:29 p.m., the Board extended executive session for 5 minutes.
At 2:34 p.m., the Board extended executive session for 5 minutes.
At 2:39 p.m., the Board extended executive session for 10 minutes.
At 2:50 p.m., the Board extended executive session for 10 minutes.
At 3:00 p.m., the Board extended executive session for 5 minutes.
At 3:05 p.m., the Board extended executive session for 5 minutes.
At 3:10 p.m., the Board extended executive session for 2 minutes.
At 3:13 p.m., the Board extended executive session for 2 minutes.
At 3:15 p.m., the Board extended executive session for 2 minutes.
At 3:17 p.m., the Board extended executive session for 2 minutes.
At 3:20 p.m., the Board extended executive session for 5 minutes.
At 3:25 p.m., the Board extended executive session for 2 minutes.
Executive session ended at 3:27 p.m. Commissioner Pollock noted that no decisions had been made
during executive session.
Commissioner Swope made a motion to appoint Roger Smith to the Fire District 4 vacancy as per RCW
42.12.070. Commissioner Pollock seconded. Motion passed 2-0.
Amber Smith suggested using a negotiator regarding Water District 2. Commissioner Pollock suggested
Josh Metcalf as the negotiator. Commissioner Swope seconded that recommendation. Amber asked
which option would the Commissioners would be willing to authorize from talks during executive
session and both Commissioners agreed to use option #4.
