Board Meeting Minutes 03/02/20151 BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON BOARD MEETING MINUTES March 2, 2015 The Board of County Commissioners (BOCC) for Lewis County, Washington, met in regular session on Monday, March 2, 2015, at 10:00 a.m. Commissioners Edna J. Fund, P.W. “Bill” Schulte, and Gary Stamper were in attendance. Chair Fund determined a quorum, called the meeting to order and proceeded with the flag salute. Commissioner Stamper moved to approve the minutes from the 10:00 a.m. meeting held on Monday, February 23, 2015. Commissioner Schulte seconded the motion. Motion Carried 3-0 CONSENT Commissioner Schulte made a motion to approve the Consent Agenda items one through fourteen. Commissioner Stamper seconded the motion. 1. Resolution No. 15-062 Approval of warrants and payroll for payment. Chair Fund stated this Resolution approves 314 regular warrants for a total payment against the County in the amount of $939,540.79. This also approves 238 payroll warrants dated February 20, 2015 for a total payment against the County in the amount of $221,959.00 2. Resolution No. 15-063 Re-appointing a member to the Lewis County Historical Society Board of Directors. Chair Fund stated this Resolution reappoints Bill Teitzel as the County’s representative on the Lewis County Historical Society Board of Directors for the next five years. 3. Resolution No. 15-064 Appointing a member to the WRIA 25/26 Planning Unit. Chair Fund stated this Resolution appoints Commissioner Gary Stamper to the WRIA 25/26 Planning Unit. 4. Resolution No. 15-065 Approving the inventory of the Capitalized Assets Report. Amanda Migliaccio stated Per RCW 36.32.210, the Board of County Commissioners shall, on the first Monday of March of each year, file with the County Auditor a statement verified by oath showing for the twelve-month period ending December 31st of the preceding year a full and complete inventory of all capitalized assets of the county. The provided inventory was prepared by the County Auditor's office using the asset information verified by the county departments which have custodial responsibility for the underlying assets. 2 5. Resolution No. 15-066 Approving a lease agreement with Lewis County Bar and Legal Aid. Michael Strozyk, Director of Central Services, stated Lewis County owns a building located at 19 Chehalis Ave. in Chehalis, WA. This was purchased with the understanding that the building would be demolished in the future for development of County offices/structures. The building has been vacant since purchasing it. Lewis County Bar Legal Aid has expressed an interest in relocating their services into the building and have offered to lease the building for a period of three years with a monthly rent of $700.00. This agreement would lease the structure to Lewis County Bar Legal Aid for a period of three years. Legal Aid Board Member Roberta Church stated her organization looked forward to this business arrangement as the location is very helpful to the clientele. 6. Resolution No. 15-067 Approving an aquatic land easement with the WA State Department of Natural Resources (DNR) for Skate Creek Road Bridge Stabilization Project. Tim Elsea, Public Works Director, stated Resolution 13-367 instructed the County Engineer to acquire all necessary right of way for the Skate Creek Road Bridge Bank Stabilization Project, The project extends into the Cowlitz River, therefore, requiring an easement to use State aquatic lands. Tim Elsea has reviewed an easement from the DNR for use of the state owned aquatic lands in the area of Skate Creek Bridge and recommends that the Board of County Commissioners authorize execution of the Aquatic Lands Easement. This Aquatic Lands Easement is valid for 30 years and is being granted for an administrative fee of $1,300.00 for the term. 7. Resolution No. 15-068 Approving the purchase of seven new pickups. Tim Elsea, Public Works Director, stated the Lewis County Public Works Department has determined that seven pickups in the Public Works fleet are in need of replacement. These pickups were scheduled, budgeted, and approved for replacement in 2015. Bud Clary Chrysler and Legacy Ford offer pickups through the current Washington State contract (03813). Lewis County has a cooperative governmental purchasing agreement with Washington state, and all seven pickups will be purchased with ER&R funds. Authorize the County Engineer to sign contracts between Bud Clary Chrysler, Legacy Ford and Lewis County for the purchase of seven 2015 pickups in the total amount of $192,611.27. Public Works budgeted $195,000.00 for the purchase of these vehicles. 8. Resolution No. 15-069 Approving and accepting a Quit Claim Deed from Kyle and Marina Nelson for additional right of way for Eshom Road, Centralia, WA. 3 Tim Elsea, Public Works Director, stated this resolution accepts a Quit Claim Deed from Kyle and Marina Nelson to Lewis County for additional right of way on Eshom Road as a development requirement of the City of Centralia. Property owners Kyle and Marina Nelson have applied to the City Centralia to subdivide their property within the City’s Urban Growth Area. The property has frontage on Eshom County Road. As a condition of development the City of Centralia has required the property owners to deed additional right of way for Eshom Road to the County for road purposes. It appears to be in the best public interest to accept this right of way into the county road system as a part of Eshom Road. 9. Resolution No. 15-070 Approving the transfer of a portion of McCormick Creek Road and Remmen Road right of ways to the State of Washington Department of Transportation, by Quit Claim Deed. Tim Elsea, Public Works Director, stated the attached resolution approves the transfer of a portion of McCormick Creek Road and Remmen Road right of ways to the State of Washington's Department of Transportation and authorizes execution of the Quit Claim Deed. Lewis County holds right of way for McCormick Creek Road and Remmen Road as shown colored in red and shown on the attached Exhibit A, located within the proposed right of way for the SR 6, McCormick Creek to Pe Ell project. The State of Washington, Department of Transportation's SR6, McCormick to PeEll project, requires that the State acquire the County's rights over portions of McCormick Creek Road and Remmen Road right of ways as described in the Quit Claim Deed. The attached resolution approves the transfer of a portion of McCormick Creek Road and Remmen Road right of ways as described on the attached Quit Claim Deed from Lewis County to the State of Washington Department of Transportation. 10. Resolution No. 15-071 Approving the transfer of a portion of Airport Road and Eckerson Road right of way within the SR5 Mellen St. to Blakeslee Junction project by Quit Claim Deed to the State of Washington Department of Transportation. Tim Elsea, Public Works Director, stated Approving the transfer of a portions of Airport Road and Eckerson Road right of way within in the SR5, Mellen St to Blakeslee Junction project by Quit Claim Deed to the State of Washington Department of Transportation. 11. Resolution No. 15-072 Bid award for the Solid Waste Tipping Floor Scale Project. Tim Elsea, Public Works Director, stated a Call for Bids was made on January 26, 2015. The project was advertised for two consecutive weeks in The Chronicle and The 4 Daily Journals of Commerce, Seattle and Portland. The project was also listed on Lewis County's website. Public Works received 1 responsive bid on February 24, 2015. Powell Scales NW Inc., provided the responsive base bid of $214,866.00 which will include disposing of the existing scales, and an alternate bid of 211,626.00 which includes leaving the scales for Solid Waste Department disposal. Lewis County Public Works has determined that the cost savings of the alternate bid will not offset the cost of disposing of the scales. Public Works staff recommends acceptance of the low base bid provided by Powell Scales NW, Inc. in the amount of $214,866.00. 12. Resolution No. 15- 073 Appointing Commissioner Fund as Board member and Commissioner Stamper as Alternate member to the Timberland Regional Support Network Governing Board (TRSN). Danette York, Director of Health & Social Services, stated the Timberlands Regional Support Network (TRSN) is required to be governed by representation from each county in the TRSN. The member representative must be appointed by the Board of County Commissioners (BOCC) of its respective county. Lewis County BOCC has decided to appoint Commissioner Edna J. Fund as Board Member and Commissioner Gary Stamper as Alternate member to the TRSN Governing Board. These appointments will ensure continued leadership on the TRSN Governing Board and represent the interests of Lewis County in Mental Health Services which are provided through the TRSN. 13. Resolution No. 15-074 Approving Contract Amendment No. 12 to Program Agreement No. 1163-27316 with the Division of Behavioral Health and Recovery (DBHR). Danette York, Director of Health & Social Services, stated Department of Social & Health Services (DSHS) contracts with county governments to coordinate, subcontract, and monitor treatment and prevention programs at the local level. These funds are then contracted with local treatment agencies to provide the services directly. This contract amendment will increase funding to the current DBHR contract agreement. This amendment is effective February 15, 2015 through June 30, 2015. The contract is from July 1, 2014 – June 30, 2015. This amendment will increase the current contract by $27,407.00 for a total program agreement amount of $2,916,680.00. 14. Resolution No. 15-075 Approving a contract with the Washington State Health Care Authority (HCA). Danette York, Director of Health & Social Services stated the federal-level Centers for Medicare & Medicaid Services (CMS) encourage government entities such as county health departments to participate in the Medicaid Administrative Claiming 5 program. Administrative claiming is allowed under federal law when local agencies provide services which are classified as outreach and linkage to individuals who are potentially eligible for Medicaid. These services include activities associated with informing potentially eligible people about Medicaid, connecting them to service providers, and the development of community services. Reimbursing local agencies is possible because HCA has limited staff but is required by their contract with CMS to provide these services. Reimbursement works by having all staff that may carry out these activities participate in time studies to document the use of their time. Quarterly, PHSS submits a bill indicating the amount of time spent on each activity and the staffing costs. HCA reimburses PHSS at a 50% rate for standard activities and at a 75% rate for activities which must be carried out by a licensed professional (e.g., RN, MSW). Administrative claiming allows PHSS to receive additional funding for activities usually done by staff as they carry out their daily work assignments.
