BOARD MEETING MINUTES
August 24, 2015
The Board of County Commissioners (BOCC) for Lewis County, Washington, met in
regular session on Monday, August 24, 2015, at 10:00 a.m. Commissioners Edna J.
Fund, Gary Stamper, and P.W. “Bill” Schulte were in attendance. Chair Fund, called
the meeting to order, determined a quorum, and proceeded with the flag salute.
Commissioner Stamper moved to approve the minutes of the 10:00 a.m., Monday,
August 17, 2015 Business Meeting. Commissioner Schulte seconded the motion.
Motion carried 3-0.
Public Comment
Roy Fenstermaker, Winlock, commented on item No. 3 stating that he does not want
to sell his property to the County. He showed a map of the property showing the portion
of the property that the County wants to purchase. He stated he is willing to see the
property on the side of the road that his home is on he doesn’t have a problem selling.

recommends them adjusting the pond so they don’t have to use Mr. Fenstermakers
property at all.
CONSENT
Commissioner Schulte moved to approve the Consent Agenda items one through six.
Commissioner Stamper seconded the motion.
1. Resolution No. 15-239 Approval of warrants and payroll for payment.
Amanda Migliaccio, Auditor’s Office, stated this resolution approves 231 regular
warrants for a total payment against the County in the amount of $1,868,498.58. This
also approves 241 payroll warrants dated August 20, 2015 for a total payment against
the County in the amount of $275,062.00.
2. Resolution No. 15-240 Approving an agreement regarding the proposed
purchase of property located at 242 NW Chehalis Ave., Chehalis, WA.
Michael Strozyk, Director of Central Services, stated this Resolution would approve
an agreement between the County and Daryl J. Lund for the purchase of property at
242 NW Chehalis Ave, Chehalis, WA and ratifies the signature of the Central Services
Director. Property adjacent to Lewis County Courthouse Campus located at 242 NW
Chehalis Ave, Chehalis, WA was recently offered for sale to the County by the owner.
There are significant advantages to the County owning this property including additional
parking and to support future County projects. This project has been identified as part of
a master plan.

3. Resolution No. 12-241 Regarding the necessary purchase of additional right of
way for the Highway 603 Stabilization Project.
Tim Elsea, Director of Public Works, stated the Lewis County Transportation
Improvement Plan includes the Highway 603 Stabilization Project. There are four
properties that they are looking to purchase. He went over Exhibit A showing the four
properties. He then went over a map showing a 50 MPH curve. Originally they were
asking Mrs. Coward for more property. She did not like the purchase so they then
redesigned to curve to a 40 mph speed. He showed the map of the 40 mph curve and it
would require very little property from Mrs. Coward. We then needed approval for
CRAB who agreed to the change. We have negotiated with 21 property owners total
and have the four property owners remaining. Mr. Fenstermaker is offering a proposal
today that we haven’t heard and we are happy to look at that before taking it forward.
This Resolution will allow the Prosecutors office to acquire the final right of way.
Commission Schulte asked if we give you permission today to move forward with this
eminent domain we could still between now and the contract review the options
proposed and make those changes.
Tim Elsea stated we will look at it and it is probably that we will have negotiations with
all of these property owners concluded before any other step takes place.
Mr. Sanchez spoke and Glenn Carter assisted with translation.
Mr. Sanchez does not want to sell his property but feels he has no other option but to
do so. His property is bordered on two sides one on Nelson Road and the other on Hwy
603. He feels the offer of $20,000 is not a just price. One of his concerns is his
driveway, the driveway is very wide and he is concerned that the project will narrow his
driveway. He also has put a lot of time, effort, and investment into improving his
property and he feels that those improvements have not been recognized at this time.
He is concerned about what the remaining shape of the property as proposed.
4. Resolution No.15-242 Bid award for the Davis Creek Road Turnaround and US
Highway 12 Intersection Improvement Project.
Tim Elsea, Director of Public Works, stated this contract provides for the
improvement of Davis Creek Road intersections with US Highway 12 and construction
of new turnarounds by clearing and grubbing, excavation, asphalt concrete pavement,
placing riprap, installation of a culvert, permanent seeding and other work in accordance
with the Contract Plans, Provisions, and the Standard Specifications. Public Works
received 4 responsive bids for this project on August 11, 2015. Sterling Breen Crushing,
Inc. provided the lowest responsive bid of $560,595.60. The Engineer's Estimate for this
project was $539,460.00. The lowest responsive bid is over the Engineer's Estimate by
less than 4%. Public Works staff recommends acceptance of the low bid provided by
Sterling Breen Crushing, Inc.

5. Resolution No. 15-243 Approving an inter-local agreement for chemical
dependency treatment with the Department of Social and Health Services
(DSHS), Division of Behavioral Health and Recovery (DBHR) and Lewis
County.
April Kelley, Social Services Manager, stated the State contracts with the County who
then subcontracts with local agencies to provide services directly. DSHS contracts with
county governments to coordinate, subcontract, and monitor chemical dependency
treatment and prevention programs at the local level. Funds are used by local treatment
agencies to provide chemical dependency treatment. The Period of this contract is from
July 1, 2015 through March 31, 2016. The total maximum program agreement amount
is $383,100.00.
6. Resolution No. 15-244 Authorizing initial placement of casual Environmental
Health Specialists to be placed on the current Lewis County Salary Grid.
April Kelley, Social Services Manager, introduced the Resolution.
Commissioner Schulte stated this Resolution is for a temporary food inspector.
During periods of seasonal events, the county may have several temporary food
vendors that need to be inspected. Currently, we have two regular staff food inspectors.
Two inspectors are unable to complete the inspections of all of the temporary food
vendors during regular working hours.
Motion carried 3-0.
There being no further business, the BOCC’s business meeting adjourned at 10:43 a.m.
on August 24, 2015. The next public meeting will be held Monday, August 31, 2015.
