2014-07-14 Board Meeting Minutes1 BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON BOARD MEETING MINUTES July 14, 2014 The Board of County Commissioners for Lewis County, Washington, met in regular session on Monday, July 14, 2014, at 10:00 a.m. Commissioners F. Lee Grose, Edna J. Fund, and P.W. “Bill” Schulte were in attendance. Chairman Grose determined a quorum, called the meeting to order and proceeded with the flag salute. Commissioner Schulte moved to approve the minutes from the 10:00 a.m. meeting held on Monday, July 7, 2014. Commissioner Fund seconded the motion. Motion Carried 3-0 CONSENT Commissioner Fund made a motion to approve the Consent Agenda items one through eight. Commissioner Schulte seconded the motion. 1. Resolution No. 14-209 Approval of warrants and for payment. Chairman Grose stated this Resolution approves 89 regular warrants for a total payment against the County in the amount of $261,874.58. 2. Resolution No. 14-210 Approving an addendum to the Department of Corrections prisoner housing contract. Kevin Hanson, Sheriff’s Office, stated the Department of Corrections is proposing an addendum to the existing prisoner housing contract. This addendum mandates compliance with the federally mandated Prison Rape Elimination Act (PREA) which was adopted by the government in 2003. The act aimed to curb prison rape through a "zero- tolerance" policy, as well as through research and information gathering. The act called for developing national standards to prevent incidents of sexual violence in prison. Since the adoption of the new mandate, the Sheriff's Office has implemented policy and practices to ensure compliance. Part of the compliance and certification is to pass a PREA audit. The audit is conducted by private contractors who are certified by the Department of Justice. The audit is extensive and includes review of policies and practices. We are currently in the process of negotiating a contract with the contractor and estimate the audit to occur by the end of the year, 3. Resolution No. 14-211 Establishing the salary and benefits for the Sheriff’s Office Corrections Captain. 2 Kevin Hanson, Sheriff’s Office stated In early 2012, a collaborative attempt was made by the Jail Lieutenants and Teamsters Local 252 to unionize the two non-represented Lieutenant positions into the existing Corrections Sergeants unit. Before the issue was resolved by PERC, an agreement was reached in October 2012 via MOU regarding the represented status of the Lieutenant positions. The MOU provided for the Custody Lieutenant to join the union and the Administrative Lieutenant to be reclassified and remain non-represented. The reclassification of the Administrative Lieutenant position to a Captain position has already occurred through action by the Lewis County Civil Service Commission. Recently, the salary for the Custody Lieutenant was resolved through CBA negotiation. The next step is to establish the salary schedule for the non- represented Corrections Captain position to preclude salary compression in the future. 4. Resolution No. 14-212 Approving an Inter-local Agreement with the Winlock School District regarding work by Lewis County crews. Tim Elsea, Director of Public Works, stated Pursuant to authority of RCW 39.34.080 and in conformance with RCW 43.09.210, this resolution will allow the BOCC to sign and ratify an inter-local agreement that allows Lewis County crews to perform work for the Winlock School District. Winlock School District has requested that Lewis County crews complete crack sealing, chipsealing, and hot mix asphalt work on school district facilities consisting of: the grade school bus route, tennis court, middle-high school bus route, and high school parking lot, at an estimated cost of $24,153.46, which includes labor, materials and equipment, plus an administrative fee of $1,207.67, making the total $25,361.13. 5. Resolution No. 14-213 Approving an extension to the Communication Site Agreement with Weyerhaeuser NR Company for use of a radio repeater site on Baw Faw Peak. Tim Elsea, Director of Public Works, stated this Agreement from Weyerhaeuser Company to Lewis County is for the use of a radio repeater site on Baw Faw Peak and is scheduled to terminate on September 31, 2014. Weyerhaeuser NR Company has offered to extend the Agreement for a period of five (5) years, ending September 31, 2019, for rental payment amounts starting at $3,474.00 annually, increasing 3% per year, and ending at $3,910.00 annually, during the extension of the supplemental agreement. The radio site remains in use by the County and is an important part of its radio operations. 6. Resolution No. 14-214 Approving an extension to the Communication Site Agreement with Weyerhaeuser NR Company for use of a radio repeater site for emergency management communications on Baw Faw Peak. 3 Tim Elsea, Director of Public Works, stated this Agreement from Weyerhaeuser Company to Lewis County is for the use of a radio repeater site for emergency management communication on Baw Faw Peak and is scheduled to terminate on July 31, 2014. Weyerhaeuser NR Company has offered to extend the Agreement for a period of five (5) years, ending July 31, 2019, for rental payment amounts starting at $2,900.00 annually, increasing 3% per year, and ending at $3,264.00 annually, during the term extension of the supplemental agreement. The radio site remains in use by the County and is an important part of its emergency management operations. 7. Resolution No. 14-215 Approving Contract Amendment No. 1 to LCWO14 with Lewis County Work Opportunities. Danette York, Director of Health and Social Services, stated a spending plan was developed to provide employment services to individuals with developmental disabilities. The actual client service delivery hours were more than originally projected in Individual Supported Employment. This can be contributed to clients changing services or increase in services. Due to this, the contract is increased by $19,240 to increase Individual Supported Employment Services by $8,320 and Group Supported Employment Services by $10,920 for a total maximum contract amount of $155,840. 8. Resolution No. 14-216 Restricting outdoor burning throughout unincorporated Lewis County. Lee Napier, Director of Community Development stated Ratification of a resolution to restrict outdoor burning as recommended by the Building Official/Fire Marshal. This determination is based on the judgment of the Building Official/Fire Marshal which includes a review of fire-hazard conditions. This determination is consistent with adopted guidelines and will include coordination with Department of Natural Resources burn ban and closures, and with the fire districts in Lewis County. The recommendation is to impose a burn restriction to commence at 12.01 a.m. on July 12, 2014. Once conditions indicate that restrictions on outdoor burning are no longer appropriate, the Building Official/Fire Marshal will recommend to the Board of County Commissioners that the restriction be lifted. Motion Carried 3-0 Hearing Hearing: Ordinance No. 1255-Merging Timber Land Classifications Chairman Grose announced the hearing and asked for a staff report. Dianne Dorey, Assessor, stated during the 2014 legislative session, Senate Bill 6180 was passed by the Washington State Legislature which provided the county legislative 4 authority the option to merge its timber land classification with its designated forest land program. It is in the public's best interest to merge these two (2) programs into one (1). Merging the timber land classification with the designated forest land program reduces the administrative workload and reduces the processing burden on the taxpayers. If approved, any land that has been classified as Lewis County timber land will be designated as forest land under Chapter 84.33. The County Assessor will notify each owner of timber land of the merger by certified mail. If approved, when designated forest land is removed from designation, only compensating tax will be collected in accordance with RCW 84.33.140(12), unless otherwise provided by law. Commissioner Schulte asked what compensating tax is. Dianne Dorey stated compensating tax is the difference between what a person did pay under the reduced amount and what they should have paid at the highest and best use times the last nine years. Ron Averill, Centralia, asked if there was a cost for the property owners to transfer program. Dianne Dorey clarified there will not be a charge for transferring the program. Commissioner Grose asked if there were any questions. There were none. He closed the question and answer portion of the hearing and opened the formal hearing. Dianne Dorey asked that her previous comments be adopted into the record. Commissioner Grose asked if anyone else would like to testify. There was none. He closed the hearing and asked for a motion. Commissioner Schulte moved to approve Ordinance No. 1255. Commissioner Fund seconded the motion. Ordinance No. 1255 An Ordinance Terminating Timber Land Classification and Consolidating Timber Land Classification with the Designated Forest Land Program. Motion Carried 3-0 There being no further business, the Commissioners’ public meeting adjourned at 10:20 am on July 14, 2014. The next public meeting will be held Monday, July 21, 2014.
