BOARD MEETING MINUTES
April 15, 2013
The Board of County Commissioners for Lewis County, Washington met in regular
session on Monday, April 15, 2013 at 10:00 a.m. Commissioners Bill Schulte, F. Lee
Grose, and Edna J. Fund were in attendance. Chairman Schulte determined a
quorum, called the meeting to order and proceeded with the flag salute. Commissioner
Fund moved to approve the minutes from the 10:00 a.m. meeting held on Monday, April
8, 2013. Commissioner Grose seconded the motion.

Flood Authority Presentation
Scott Boettcher, Flood Authority, introduced himself and stated the Flood Authority is
going around the Basin to meet with the different basin governments to give an update
presentation to what the Flood Authority is doing and the other activities occurring in the
basin. He then did a power point presentation regarding the activities benefiting the
basin.

Commissioner Grose moved to approve Notice Agenda items one through four.
Commissioner Fund seconded the motion.
1. Call for Bids: Re-submitting the call for bids for the 2013-2014 County Legal Printing.
Bids will be opened on or after 10:00 am on Monday, May 20, 2013. Resolution No. 13-

Karri Muir, Clerk of the Board, stated Bids for the 2013-2014 County Legal Printing was
opened on April 8, 2013. Due to potential ambiguity of the bid call instructions, a decision was
made to reject all bids submitted. A new call for bids for the County Legal Printing will re-
submitted.
2. Call for Bids: For the Airport Levee Improvement Project. Bids will be opened on or
after 11:30 am on Tuesday, May 7, 2013. Resolution No. 13-119
Tim Elsea, Public Works Directors, stated The Washington State Office of Financial
Management (OFM) has funding available through the Jobs Now Program for regionally
significant projects that offer broad based community benefits. The Chehalis River Basin Flood
Authority (Flood Authority), which Lewis County is a founding member, unanimously supported
the Chehalis-Centralia Airport Levee Improvement Project (Airport Levee) for this OFM funding
opportunity at their special teleconference meeting on July 13, 2012. The OFM approved this
request and obligated $1,239,829.00 with 0% match for the Chehalis-Centralia Airport Levee
Improvement Project and the Lewis County Board of County Commissioners approved the

Interagency Agreement for project funding by Resolution No. 12-298 on September 17, 2012.
Lewis County is the Lead Agency for the Airport Levee Improvement Project. The proposed
contract provides for the improvement of 1.84 miles of the Airport Levee in Chehalis, WA by
widening the existing levee, silt fence, grading, structural excavation, constructing
embankments, structural earth wall, gravity block wall, crushed surfacing top course, and other
work, all in accordance with the Contract Plans, Contract Provisions and the Standard
Specifications. Sealed bids for the Airport Levee Improvement Project, County Project No.
FCCCAPLEV shall be submitted to the Clerk of The Board of Lewis County Commissioners
(351 N.W. North Street, Room 210, CMS-01, Chehalis, Washington 98532), by or before 11:00
A.M. on Tuesday, May 7, 2013 and will be opened on or after 11:30 A.M. on May 7, 2013. Bids
submitted after 11:00 AM will not be considered for this project.
3. Notice: Publishing the 2012 County Forces construction costs pursuant to RCW
36.77.070. Resolution No. 13-220
Tim Elsea, Public Works Directors, stated Pursuant to RCW 36.77.070, the Board of County
Commissioners is required to publish in a newspaper of general circulation, a brief description of
the work, together with an accurate statement of the true and complete cost of construction
projects completed by County Forces in 2012, where the cost of the work exceeds $10,000.
Construction by County Forces is defined in WAC 136-18-020 as construction work performed
by personnel carried on the county payroll using county owned, leased or rented equipment.
Publication of the executed resolution in the East County Journal on April 17, 2013 will fulfill the
requirements of RCW 36.77.070.
4. Notice of Hearing: Regarding the proposed vacation of a portion of the Fred Mohoric
Road. Hearing will be held on or after 10:00 am, on Monday, May 13, 2013. Resolution
No. 13-221
Tim Elsea, Public Works Directors, stated Resolution 13-076, passed by the BOCC on
March 4, 2013, declared its intent to vacate a portion of Fred Mohoric Road No. 926,
and instructed the County Engineer to examine the road and report his opinion on the
vacation, as required by RCW 36.87.010. The one property owner adjoining that portion
of the Fred Mohoric Road has requested the vacation. Utility companies known to
service the general area have been notified and there are no known utilities within the
area to be vacated. The County Engineer has prepared his report on the matter, which
is hereby submitted. If the report is accepted, passing the attached resolution would set
a May 13, 2013 hearing date for consideration of the matter. RCW 36.87.150 requires
publication at least once a week for two consecutive weeks preceding the date fixed for
the hearing, in the county official newspaper and that a copy of the notice be posted for
at least twenty days preceding the date fixed for hearing at each termini of the county
road or portion thereof proposed to be vacated.

CONSENT
Commissioner Fund made a motion to approve the Consent Agenda items five
through eleven. Commissioner Grose seconded the motion.
5. Resolution No. 13-222 Approval of warrants for payment.

Commissioner Grose stated this Resolution approves 234 regular warrants in the amount
of $732,909.52 and 1 Special Purpose District warrant in the amount of $12.60 for a
total payment against the County in the amount of $732,922.12.
6. Resolution No. 13-223 Approving an agreement between Lewis County, the City of
Chehalis, the City of Centralia and the Chamber of Commerce for tourism promotion
and operation of the Visitor’s Information Center services.
Commissioner Grose stated unlike some of our hotel motel tax recipients we actually sign a
contract with the Chamber of Commerce for visitor’s services and visitor information services for
the County. This resolution is the contract with the chambers for tourism services. We have
agreed to increase the amount this year on condition that the chamber figures out a way to stay
open on Saturdays.
7. Resolution No. 13-224 Appointing a member to the CD-MH-TC Sales Tax Advisory
Board.
Danette York, Director of Health and Social Services, stated this Resolution appoints
Tracy Mitchell as representative from Superior Court to fill the a vacated position on the
Lewis County CD-MH-TC Sales Tax Advisory Board through September 30, 2014.
8. Resolution No. 13-225 Authorizing Danette York, Director of Lewis County Public
Health and Social Services to apply for a Community Development Block Grant.
Danette York, Director of Health and Social Services, stated Lewis County has been
requested to serve as the recipient of the 2013 CDBG Public Services Grant. The
application requires that the governing authority authorize an individual as the “Chief
Administrative Official” to sign the application material.
9. Resolution No. 13-226 Approving an inter-local agreement with the City of Renton,
WA.
Tim Elsea, Public Works Directors, stated The City of Renton, Washington is in need of
replacing dump trucks in their fleet, and has become aware that Lewis County has a valid and
recently awarded contract with Kenworth Northwest (resolution #13-053). The Lewis County bid
documents include a ‘Cooperative Purchase’ clause allowing other governmental agencies to
make purchases using our contract. The City of Renton has expressed an interest in
establishing an Inter-local agreement with Lewis County as per the attached Interlocal
Agreement.
10. Resolution No. 13-227 Bid award for the 2013 Countywide Base Stabilization Project.
Tim Elsea, Public Works Directors, stated this contract allows for the improvement of various
County roads by pulverization and cement stabilization and other work in accordance with the
Contract Provisions and Standard Specifications for the 2013 3R Program. This project is listed
as number 1 on Lewis County’s amended 2013-2018 Six Year Transportation Improvement
Program (Res 13-117). This Contract will allow Lewis County to complete the following work this
year:

• Approximately 5 miles of cement treated base (CTB) on the following County
Roads
- Damron: mile post 0.010 - 0.502 (0.492 mile)
- Kruger: mile post 0.000 - 1.419 (1.419 miles)
- Middle Fork: mile post 5.780 - 6.780 (1 mile)
- Cline: mile post 3.500 - 4.780 (1.280 miles)
- Peters: mile post 1.150 - 1.960 (0.810 mile)
• Reimbursable Work for the City of Mossyrock
- Court Street mile post 0.052 - 0.159 (0.107 miles)
A Call for Bids was made on March 25, 2013. The project was advertised for two consecutive
weeks in the East County Journal and Journal of Commerce, Portland and Seattle. The project
was also listed on Lewis County’s website. Public Works received two (2) responsive bids for
this project on April 9, 2013. Ground Up Road Construction, Inc. of Milton, WA, provided the
lowest responsive bid of $271,250.12. The lowest responsive bid is below the Engineer’s
estimate.
11. Resolution No. 13-228 Bid award for the 2013 Gravel Proposal.
Tim Elsea, Public Works Directors, stated this is top rock gravel for the same roads
mentioned before and we also went out to bid on the same date. Sterling Breen Crushing,
Inc. of Chehalis, WA, provided the lowest responsive bid of $180,382.17. The lowest responsive
bid is below the Engineer’s estimate.

HEARING
HEARING: Approving Ordinance No. 1244 moving Open Space Title 17 to Title 3
in the Lewis County Code
Chairman Schulte announced the hearing and asked for a staff report.
Dianne Dorey, Assessor, stated this Public Benefit Ratings System is designed to let
taxpayers that have land going into conservation have a hearing and process to go
through. The Public Benefit Rating System was adopted in 1999, at that time the code
was put into Title 17 where it more appropriately belongs in Title 3. The change
proposing is changing the ability of a person to be in the Open Space Farm and
Agriculture Conservation for up to ten years. It was intended that this program be a
temporary solution for taxpayers having difficulty farming.
Ron Averill, Centralia, clarified the responsibility of the Public Benefits Rating System.
Chairman Schulte asked if there were any other questions. There were none. He
closed the question and answer portion of the hearing and opened the formal hearing.
Dianne Dorey asked that her previous comments be adopted into the record.

Chairman Schulte asked if there was anyone who wished to speak for or against
Ordinance No. 1244. There were none. He asked for a motion to approve.
Commissioner Grose made a motion to approve Ordinance 1244. Commissioner
Fund seconded the motion.
Ordinance No. 1244 An Ordinance Moving LCC 17.140 to LCC 3.50 and
Reinstating a 10 Year Limitation on Land Classified as Farm and Agriculture
Conservation Land.
Motion Carried 3-0
There being no further business, the Commissioners’ public meeting adjourned at 10:47
am on April 15, 2013. The next public meeting will be held Monday, April 22, 2013, at
10:00 a.m.
