BOARD MEETING MINUTES
October 7, 2013
The Board of County Commissioners for Lewis County, Washington, met in regular
session on Monday, October 7, 2013 at 10:00 a.m. Commissioners Bill Schulte, Edna
J. Fund, and F. Lee Grose were in attendance. Chairman Schulte determined a
quorum, called the meeting to order and proceeded with the flag salute. Commissioner
Fund moved to approve the minutes from the 10:00 a.m. meeting held on Monday,
September 30, 2013. Commissioner Grose seconded the motion.

Public Comment
Ron Neilson, Mineral, stated the BOCC has made it very clear that they do not care
about the problem that exist at the mineral post office. He has written a couple letter to
the Board regarding the mineral post office and the condition and never received a
response to the letters submitted.
Chairman Schulte stated the post office in mineral is outside the Boards jurisdiction.
PROCLAMATION
Commission Grose made a motion to approve Proclamation Agenda item one.
Commissioner Fund seconded. Commissioner Fund read the Proclamation into the
record.
1. Proclamation: Proclaiming October 2013 as “NOAA Weather Radio Month” in
Lewis County.
Ross McDowell, Emergency Management, stated the purpose of the NOAA weather
month is to encourage the citizens of Lewis County to purchase and use a NOAA
Weather Radio. We are asking people to follow-up with their other proportion for bad
weather and be prepared from three to five days for evacuations and two weeks of
preparedness at your house.

NOTICE
Commissioner Fund made a motion to approve Notice Agenda items two through four.
Commissioner Grose seconded the motion.
2. Notice: Public auction of surplus county property will be held at 8:00 a.m. on
October 23, 2013, at Ritchie Brothers in Chehalis, WA. A complete list of items

is available from the Lewis County Public Works Department, Road
Maintenance Service Division. Resolution No. 13-484
Tim Elsea, Director of Public Works, stated the items listed on Exhibit “A” are no
longer useful to Lewis County. The attached list of vehicles and equipment have
reached their useful life and have been replaced with new ones. We recommend this
surplus equipment be sold at auction on October 23, 2013. The advertising for surplus
property and sale will be completed by Lewis County in accordance with the surplus
property ordinance. Items listed on Exhibit “A” will be sold at Ritchie Bros Auction,
October 23, 2013.
3. Notice of Hearing: Approving the proposed transfer of the County’s interest in
the Chehalis-Centralia Airport to the City of Chehalis. Hearing will be held on
or after 10:00 am on October 21, 2013. Resolution No. 13-485
Glenn Carter, Prosecutor’s Office, stated Lewis County and the City of Chehalis
jointly own undivided interest in the Chehalis-Centralia Airport. There is a proposal at
this time to transfer the County’s interest in that Airport to the City of Chehalis. A
proposal has been made that involves several aspects. This is just a proposal. The
proposal will be heard on October 21, 2013 on or after 10:00 am.
4. Notice of Joint Hearing: The Lewis County Board of County Commissioners
and the Lewis County Solid Waste Disposal District No. 1 will hold a joint
hearing on October 28, 2013, on or after 1:30 p.m., regarding a proposed $8
per ton increase to the tipping fee for municipal solid waste received at the
Lewis County Public Works transfer stations. Resolution No. 13-486
Tim Elsea, Public Works Director, stated this resolution sets 1:30 p.m., October 28,
2013, as the time and day for the Board of County Commissioners to hold a public
hearing about a proposal to increase the municipal solid waste (MSW) tipping fee
charged at the Central Transfer Station (CTS) in Centralia and the East Lewis County
Transfer Station (ELCTS) in Morton. When the Lewis County Solid Waste Disposal
District #1 (District) began operating the (CTS) in 1994, the MSW tipping fee was
established at $95 per ton. Defeasance of bonds reduced the District’s financial
obligations in 1997, and as a result, the District authorized the tipping fee to be lowered
to $82 per ton at the CTS and the ELCTS, which began operation in 1997. The District
Fund 415 was profitable until the economy weakened, and MSW tonnage declined,
resulting in revenue losses at the end of the last four years even though Solid Waste
management reduced operating expenditures to alleviate declining revenue. The
Director of Lewis County Public Works has estimated what the 2014 year-end balance
of District Fund 415 will be based on the current tipping fee and on increases of $5, $8,
and $10 to the current fee. The Public Works Director concluded that increasing the
current rate of $82 per ton by $8 per ton for a total of $90 per ton would be in the
public’s best interest. The Lewis County Solid Waste Advisory Committee, advisors to
the Board of County Commissioners, studied the Public Works Director’s tipping fee

projections, and passed a motion at its Sept. 5, 2013 meeting recommending an
increase to the tipping fee of $8 per ton, which would make the new fee $90 per ton.
According to RCW 70.95.212, the new tipping fee may be effective at least 75 days
after haulers have been given notice so that solid waste collection companies have time
to prepare and submit tariffs and rate filings for public comment; and to allow time for
the Washington Utilities and Transportation Commission to review the collection
companies’ tariff requests.

CONSENT
Commissioner Grose made a motion approve Consent Agenda items five through
nine. Commissioner Fund seconded the motion.
5. Resolution No. 13-487 Approval of warrants and payroll for payment.
Commissioner Grose stated this Resolution approved 9 special purpose warrants in
the amount of $11,848.63 and 212 regular warrants in the amount of $525,087.75 for a
total payment against the County in the amount of $536,936.38.
6. Resolution No. 13-488 Approving contracts with Morningside, Reliable
Enterprises and Lewis County Work Opportunities.
Danette York, Director of Public Health and Social Services, stated this contracts
between Lewis County and Morningside, Reliable Enterprises, and Lewis County Work
Opportunities. The State Department of Developmental Disabilities contracts with Lewis
County to oversee the administration of grant money for employment services to adults
with developmental disabilities. Lewis County will act as the fiscal agent providing
reimbursement to these agencies for services through a contract between Lewis County
and the DDD Region 2. DSHS/DDD requires that the county contract with approved
Community Rehabilitation Programs for employment services. Lewis County does not
have the staff or expertise to provide specialized employment services. These agencies
are approved and have the expertise to provide specialized employment services.
Funding for this contract comes from the state contract with DSHS/DDD.
Reliable Enterprises: $325,029.00
Morningside: $236,400.00
Lewis County Work Opportunities: $136,600.00
Total Consideration: $698,029.00
The period of this contract will extend from July 2013 - June 2014.
7. Resolution No. 13-489 Approving the Coordinated Prevention Grant Agreement
with the Washington State Department of Ecology.

Danette York, Director of Health and Social Services, stated this Resolution
approves a Coordinated Prevention Grant Agreement between Washington State
Department of Ecology and Lewis County. Washington State Department of Ecology
contracts with local health jurisdictions to perform solid waste enforcement and
permitting activities. The goal of the CPG program is to provide funding assistance to
local governments for planning and implementing some programs in their local solid and
hazardous waste management plans. Grant #G1400099 Amount of Total Contract for
2013 - 2015 is $177,096. State Grant share is $132,822 and the 25% match
requirement is $44,274. Effective July 1, 2013 through June 30, 2015. The agreement
was delayed at the State level. Lewis County received the formal offer on September
11, even though the agreement started July 1, 2013.
8. Resolution No. 13-490 Approving an inter-local with the Lewis County Fire
District No. 13 for radio repair and maintenance services.
Michael Strozyk, Director of Public Services, stated we have several of these
agreements in place with our local public safety agencies for repair and maintenance on
their radio equipment. One of the problems we run into in our community is due to the
economy both radio repair commercial venders have closed business. This agreement
will run through December of 2014 and allows Boisfort Valley to bring their equipment
into us and we will repair and maintain it for a fee of $50.00 per hour and $75.00 for
after hours and $0.50 per mile if we have to transfer out.
9. Resolution No. 13-491 Approving the proposed acquisition of additional right
of way for Cousins Road, Adna, WA.
Tim Elsea, Director of Public Works, stated we have a culvert that needs to be replaced
along Cousins Road. This project will require additional right of way from two property
owners. RCW 8.08.010 authorizes Counties to acquire property under the threat of
eminent domain when deemed necessary by the Board of County Commissioners.
Pursuant to the requirements of RCW 8.08, this resolution instructs the County
Engineer to acquire right of way from owners of two properties along Cousins Road for
the project. All such acquisition shall be in accordance with adopted procedures as per
Resolution 09-381 and under its eminent domain authority for purposes of real estate
excise tax, as per RCW 8.25 and WAC 458-61A-206(1C), and pursuant to authority and
obligations of RCW title 8, notably 8.08, 8.25 and 8.26.

HEARING
• Hearing: 2014 Preliminary Budget
Chairman Schulte announced the hearing and asked for a staff report.

Dawna Truman, Budget Director, stated copies of the preliminary budget and brief are
at the front of the room. We have also posted it online and placed it in Colleges and
Libraries around the County. We will be presenting an evening presentation on
November 18, 2013 at 5:30 pm. A preliminary budget was submitted to the BOCC and
the Auditor on September 3, 2013. Meeting have been held through the months in
September for each office and elected official to discuss their budget with the
Commissioners. The second hearing will be help on December 2, 2013 which will be
the day of adoption of the budget. Preliminary budget sets current expense revenue at
$31,138,647.00, expenditures at $33,948,153.00. The total of the preliminary budget is
expected to be revenue in the amount of $96,095,798.00 and expenditures in the
amount of $100,206,374.00. Revenue from previous years will be used to balance the
budget.
Chairman Schulte asked if there were any other questions. There were none. He

• Hearing: Adoption of Ordinance 1246 amending LCC 16.02 Subdivision
General Provisions
Chairman Schulte announced the hearing and asked for a staff report.
Stan May, Community Development, stated LCC 16 is specifically about exemptions.
The first exemption LCC 16.02 #9 exempts land divisions of 20 acres or more from the
provisions of title 16. This particular exemption is not consistent with the minimum lot
size requirements of 80 acres for land designated as Forest Resource Lands (FRL)
which would make it consistent. The amendment would increase the exemption within
FRL only to 80 acres. The second part of this a new exemption on conservation lots.
Occasionally small portions of large tracks are found to be not suitable for resource land
use due to wetland and other environmental features and limitations. We had two public
hearings and two workshops with the planning commission and the code amendment
reflects suggestions made during those hearings and workshops.
Ron Averill, Centralia, asked for an explanation on what we are doing with the
conservation lands. If I only have an 80 acre plot for FRL and go into conservation does
it go under the 80 acre?
Stan May stated part of the provision of the conservation lot is whatever is left over
cannot be smaller than the minimum lot size for that areas. You would need to have
more than 80 acres and then you could slice of the excess as long as you have the
minimum of 80 acres.

Roberta Church, Mineral, asked the maximum would still be the one house in 80
acres? Does this give land owners any new rights? Does the amendment to the
subdivision change the zoning requirement?
Stan May stated yes maximum would be the one house for 80 acres, only on the
conservation provision but the 80 acres actually restricts certain amount of rights, and
no this does not change the zoning requirements,
Ron Nielson, Mineral, asked will the new amendment allow subdivision of less than 80
acres in a development of FRL of long term significant?
Stan May stated that doesn’t change.
Ron Nielson asked will this amendment allow subdivisions of less than 20 acres and
development of FRL of local significant.
Stan May stated this does not change the zoning code.
Ron Nielson asked will this amendment result and the violation of any SEPA and GMA
laws.
Stan May stated no.
Chairman Schulte asked if there were any other questions. There were none. He
closed the question and answer portion of the hearing and opened the formal hearing.
Lee Napier and Stan May asked that their previous comments be adopted into the
record.
Commissioner Grose stated this is a clarification amendment to clarify and prevent
large scale land owners in FRL from subdividing there land without any development
regulations.

Commissioner Fund moved to approve Ordinance No. 1246. Commissioner Grose
seconded.
