BOARD MEETING MINUTES
February 6, 2012
The Board of County Commissioners for Lewis County, Washington met in regular
session on Monday, February 6, 2012 at 10:00 a.m. Commissioners F. Lee Grose,
Bill Schulte, and Ron Averill were in attendance. Chairman Grose determined a
quorum, called the meeting to order and proceeded with the flag salute. Commissioner
Averill moved to approve the minutes from the 10:00 a.m. meeting held on Monday,
January 30, 2011. Commissioner Schulte seconded the motion.

NOTICE
Commissioner Averill asked to postpone discussion of item one until Margaret Shields
arrives. Commissioner Averill moved to approve Notice Agenda item two.
Commissioner Schulte seconded the motion.
2. Proclamation: Proclaiming the month of February 2012, as “Dating Violence
Awareness Month”.
Commissioner Averill read the Proclamation into the record.
Caitlin Bailey and Sara White, Human Response Network stated the victim
advocates at the Human Response Network wish to thank the Lewis County
Commissioners for proclaiming February as Dating Violence Awareness Month. It is
important that we as a community work together to ensure that our young people
experience healthy non-violent relationships. We all have a role in reducing and
preventing dating violence whether you are a parent, teach, prevention educator, or
someone just interested in breaking the cycle of violence. We hope that this
proclamation will raise awareness about dating violence for our young people and for
the people who work with them and parent them. Thank you for recognizing this
problem that affects Lewis County Youth.

Commissioner Averill moved to approve Notice Agenda items three and four.

3. Notice: Publishing the opening of the Small Works Roster for Lewis County. .
Resolution No. 12-041
Tim Elsea, Director of Public Works, stated the attached resolution will allow opening
the Small Works Roster to obtain applications from businesses interested in having their

business placed on one or more of the rosters. The Small Works Roster allows the
County and agencies holding inter-local agreements to use contractors on the
established list for projects between $35,000 and $300,000. Agencies currently holding
inter-local agreements are Lewis County Conservation District, Lewis County Fire District
#1 (Onalaska), Lewis County Fire District #2 (Toledo), Lewis County Fire Dist. #8
(Salkum), Lewis County Fire Dist. #11 (Pe Ell), Lewis County Fire Dist. #14 (Randle),
Lewis County Fire Dist. #15 (Winlock), Cowlitz-Lewis County Fire Dist. #20, Lewis County
Water District #1 and the Chehalis-Centralia Airport. The Small Works Roster will remain
open per RCW 39.04.155. Every year we advertise for opening this roster and anyone
who is interested and qualifies can apply for being added to this roster at any time
during the year.
Commissioner Averill stated the reason we have a small works roster is it allows us to
abbreviate the selection process on projects between $35,000.00 and $300,000.00.
He asked Tim to give some examples of who is on this roster.
Tim Elsea gave examples of types of business on this roster.
4. Call for Bids: Regarding the Lewis County Road Safety Project-Phase I. Bids
are due on February 28, 2012, by 11:00 am. Resolution No. 12-042
Tim Elsea stated this Resolution calls for bids for Phase 1 of the Lewis County Road
Safety Project. Lewis County previously applied for and was awarded $1,525,000.00
for safety improvements to major collector and minor arterial roadways countywide.
This grant is 100% federally funded through Federal Highway Administration Surface
Transportation Program. This project will be completed in two phases. Phase 1
construction will include flexible guide post installation by contract along with regulatory,
guidance, warning signs, and pavement marking materials installed with Agency force
work. Phase 2 construction will include installation of guardrail at locations on roadways
and intersections identified by accident data and guardrail warrants. Phase 2
construction will be authorized by a separate Federal Aid Project number. Phase 1
construction has been authorized by WSDOT Local Programs and this bid call will allow
Public Works to solicit sealed bids for contractor installation of approximately 3,300
flexible guideposts. This project is listed as number 17 on Lewis County’s 2012 Six
Year Transportation Improvement Program. The proposed contract will provide for the
improvement of approximately 95 miles of roadway, in Lewis County, by placing Flexible
Guide Posts, traffic control on various roads, and other work as directed by the
Engineer. Sealed bids for the Lewis County Road Safety Project Phase 1 shall be
submitted to the Clerk of the Board of Lewis County Commissioners (351 N.W. North
Street, Room 210, CMS-01, Chehalis, Washington 98532), by or before 11:00 A.M. on
Tuesday, February 28, 2012. Bids submitted after 11:00 A.M. will not be considered for
this project. Bids will be opened on or after 11:30 A.M. in the Commissioners Hearing
room.

CONSENT
Commissioner Schulte moved to approve Consent Agenda items five through ten.
Commissioner Averill seconded the motion. Candace Hallom read the items into the
record.
5. Resolution No. 12-043 Approval of warrants and payroll for payment.
Commissioner Averill stated this resolution Approves 150 warrants issued by the
Auditor’s Office for $143,105.37. Also approves 430 automatic deposits checks totaling
$1,220,912.52; and, 144 payroll warrants for net pay, and 62 payroll warrants for
benefits/deductions for a total $3,203,838.90.
6. Resolution No. 12-044 Approval of an agreement with Washington State Office
of Public Defense for public defense improvement funds.
Commissioner Averill stated this resolution approves an agreement between Lewis
County and the Washington State Office of Public Defense for Public Defense
Improvement funds in the amount of $45,653.00. The contract is for a half year period
from January 1 through June 30, 2012 and is provided to improve the quality of public
defense services in Washington State Counties. The Lewis County Board of County
Commissioners contract with individual defense attorneys in the County to provide
public defense services in both the District and Superior Court. These funds are used
to improve public defense services.
7. Resolution No. 12-045 Adoption of the 2012 Standard Specifications for road,
bridge, and municipal construction.
Tim Elsea, Director of Public Works, state this resolution adopts the 2012 Standard
Specifications for Road, Bridge, and Municipal Construction as per Local Agency
Guidelines (LAG), Certified Acceptance (CA) Program and RCW 36.86.080. RCW
36.86.080 requires all new construction to the extent feasible to be done in uniform
design standards. RCW 36.86.020-030 sets forth the basic requirements for the
creation, adoption and use of minimum construction standards for county roads and
bridges and requires them to be used for all construction and, as far as practicable, for
all reconstruction of roads comprising the county road system. The Washington State
Department of Transportation and the American Public Works Association have
adopted the 2012 Standard Specifications for Road, Bridge, and Municipal Construction
governing construction requirements that went into in effect beginning January 2, 2012.
As required by the Certified Agency Agreement with WSDOT, Lewis County must adopt
the same.
8. Resolution No. 12-046 Appointment of a member to the Lewis County Planning
Commission.
Robert Johnson, Director of Community Development, stated this is an appointment
to fill a position that was previously filled by Bill Russell on the Planning Commission.

He thanked Bill Russell for the many years he served on the Planning Commission. Bill
served during a time when the County was dealing with some real important issues and
policy decisions. Mr. Russell’s term ended on December 31, 2011. The Planning
Commission is a volunteer board appointed by the Board of County Commissioners and
serves a very important function to provide recommendations to the Planning
Department and the Board of County Commissioners. This resolution is for the
appointment of Clinton M Brown, Jr. (Randle) to a four year term, expiring December
31, 2016, on the Lewis County Planning Commission.
Commissioner Averill stated the Planning Commission is divided so it represents all
districts of the County. There are seven members represented on the Planning
Commission. Bill Russell was very dedicated to the Board and we thank him for his
dedication and assistance to the County.
9. Resolution No. 12-047 Reappointment and Appointment of members to the
Timberland Regional Support Network Quality Review Team.
Tara Smith, Social Services, stated this resolution approves the reappointment of
LaRonna Lorber (Chehalis), and appointment of Tracy McDougall (Chehalis) to the
Timberland Regional Support Network Quality Review Team (QRT) for a period of two
(2) years, ending December 2013. Their role on this team is to review cases of
individuals who receive mental health treatment and look at the quality of services being
provided.
Commissioner Averill stated we had one position empty for over a year so this is good
that we have two members back on the quality review team to work with Cascade
Mental Health and the clients in the area.
10. Resolution No. 12-048 Supporting a secure, convenient medicine return
program to reduce public safety and environmental impacts of unwanted
medicine.
Tara Smith, Social Service, stated this is a resolution to support legislation that is
moving forward in the State to have pharmaceutical companies be responsible for
paying for the secure take back of medications. This is to reduce environmental
concerns of disposal and drug abuse. Currently we have a medication disposal
program in the County and there are five different drop boxes. They were put in place
with funding from a grant but Law Enforcement has to weigh, empty, and take them in
as evidence and dispose of it on a voluntary basis. It is at a cost to the County to
provide this service. This legislation would make the pharmaceutical companies
responsible for that.
Commissioner Schulte stated Lewis County has been running this program for a
couple of years even before the bill was proposed. It used to be that the doctors would
recommend that you flush the unused portion of your medicines down the toilet and that
started showing up in water supplies.

Commissioner Averill stated we are ahead of the curve but the State is not and that is
why we have chosen to get on board and endorse the legislation that is before the
legislature. The federal government has been taking back medications for as long as
he could remember. It makes great sense that the local pharmacies take the
medications back and provide for the disposal.

Commissioner Averill moved to approve Consent Agenda item eleven. Chairman
Grose seconded the motion. Candace Hallom read the items into the record.
11. Resolution No. 12-049 Authorizing legal defense and indemnity for a Lewis
County employee.
Paulette Young, Risk Manager, stated Lewis County Commissioner Schulte and “Jane
Doe” Schulte have been named in a legal action filed in the United States District Court
for the Western District of Washington for allegations made while in the course of
performance of his duties for Lewis County. Commissioner Schulte has requested
defense and indemnification for himself and “Jane Doe” Schulte pursuant to resolutions
03-042 and 04-165. Under this resolution Michael and Alexander PLLC will be
requested to provide legal defense for Commissioner Schulte and “Jane Doe” Schulte.
He is only named as one of the defendants in this lawsuit. Lewis County, the Board of
County Commissioners, and Bill Schulte were all named in this lawsuit.
Motion Carried 2-0 Commissioner Schulte abstained
Margaret Shields did not appear Commissioner Averill moved to approve agenda item
one. Commissioner Schulte seconded.

Commissioner Averill read the Proclamation into the record.
Edna Fund stated Margaret Shields is a treasure of Lewis County. She was a Rosie
the Riveter at the Boeing plant in the old PUD Building. She was born in this area and
has lived a lot of history. She has more data in her brain than any of the files at the
museum. She is someone we need to really celebrate. She is 90 years old and has
been a volunteer for 34 years. Edna hopes everyone will come and rejoice with us as
Margaret receives her award from the South Sound Heritage Association.

Hearing
Hearing: Traffic Ordinance No. 215 setting speed limit on Joppish Road

Chairman Grose announced the hearing and asked for a staff report.
Eric Martin, Public Works, stated an investigation was conducted in 2011 based on
comments from citizens that lived off of Joppish Road. Joppish Road is a rural local
access road and is 1.775 miles in length. There is a portion of this road currently
posted at 25 mph which runs through a residential area and the speed limit for the
remainder of the road is 50 mph. There are several horizontal curves in that 50 mph
section that were taken into consideration in the study. The study was conducted and
found that there is a lot of voluntary compliance already with a 40 mph speed limit. The
85% of vehicles travel at 40 mph which made the decision fairly easy. In the last five
years there were four run off the road accidents which also would suggest the need for
a lower speed limit.
Tim Elsea explained 85% which is basically 85% of the people are driving that road at
that speed or lower.
Chairman Grose asked if there were any more questions. There were none. He closed
the question and answer portion of the hearing and opened the formal hearing.
Eric Martin and Tim Elsea asked that their previous comments be adopted into the
record.
Chairman Grose asked if there were any other statements for public testimony. There
were none. He closed the hearing and asked for a motion.
Commissioner Averill made a motion to approve Traffic Ordinance No. 215.
Commissioner Schulte seconded the motion. Candace Hallom read the item into the
record.
Traffic Ordinance No. 215 An Ordinance Fixing the Maximum Speed at Which
Vehicles May be Operated Over Joppish Road in Lewis County, Washington:
Defining Offenses and Providing Penalties for the Violations Thereof

There being no further business, the Commissioners’ public meeting adjourned at 10:49
am on February 6, 2012. The next public meeting will be held Monday, February 13,
2012, at 10:00 a.m.
