BOARD MEETING MINUTES
October 24, 2011
The Board of County Commissioners for Lewis County, Washington met in regular
session on Monday, October 24, 2011 at 10:00 a.m. Commissioners Ron Averill,
P.W. “Bill” Schulte, and F. Lee Grose were in attendance. Chairman Averill
determined a quorum, called the meeting to order and proceeded with the flag salute.
Commissioner Grose moved to approve the minutes from the 10:00 a.m. meeting held
on Monday, October 17, 2011. Commissioner Schulte seconded the motion.

EMPLOYEE RECOGNITION
Employee “Above & Beyond” Award
Chairman Averill stated last week we had our quarterly above and beyond awards and
one of our nominees was not able to attend but he is present today. Chairman Averill
announced Jason Mauermann as one of the 3rd Quarter employee “Above and Beyond”
awardees.

Commissioner Schulte moved to approve Notice Agenda items one and two.
Commissioner Grose seconded the motion. Candace Hallom read the items into the
record.
1. Call for Bids: For a Telehandler for the Southwest Washington Fairgrounds.
Bids will be opened on or after 11:30 am, on Tuesday, November 8, 2011.
Resolution No. 11-339
Tim Elsea, Director of Public Works, stated the Southwest Washington Fairgrounds
within the Lewis County Department of Central Services has made a request to replace
their forklift with a Telehandler. Specifications for a replacement have been prepared
and are attached to the resolution. Fleet Services proposes a Call for Bids from
potential vendors for the purchase of a used Telehandler to replace the existing forklift.
Bids are due by 11:00 a.m. on November 8, 2011, to the Clerk of the Board of Lewis
County Commissioners (351 NW North St., Room 210, CMS-01, Chehalis, Washington
98532) and will be publically opened at 11:30 a.m. on November 8, 2011 at the
Commissioners Meeting Room, 351 NW North St., Room 223, CMS-01 Chehalis,
Washington 98532.
2. Notice of Hearing: Regarding Ordinance 1232 that will increase the maximum
number of consecutive terms for appointed Planning Commissioners from two

to three. Hearing will be held on or after 10:00 am on Monday, November 7,

Robert Johnson, Director of Community Development, stated under existing County
Code Chapter 2.11, planning commission members may only serve a maximum of two
consecutive terms (8 years, total). When the planning commission was reorganized in
2005, the original member terms were established with terms between one and four
years. Under the existing code provisions, the initial appointees will serve total terms of
from five to eight years. The Board of County Commissioners appoint planning
commission members. It has been difficult to recruit qualified planning commission
members and there is a desire to allow longer terms. The Board must hold a public
hearing and take testimony prior to acting on this code amendment. It is a procedural
amendment and is not subject to the public participation requirement for a
comprehensive plan or new implementing development regulations under RCW 36.70A.
Following proper notice and a public hearing on the matter, the Board may act
immediately, independent of yearly comprehensive plan or rezone requests.

CONSENT
Commissioner Grose moved to approve Consent Agenda items three through ten.
Commissioner Schulte seconded the motion. Candace Hallom read the items into the
record.
3. Resolution No. 11-341 Approval of warrants and payroll for payment.
Chairman Averill stated this approves 10 Special Purpose Warrants (Vader Water
System) for $13,208.06 and 236 warrants issued by the Auditor’s Office for
$1,145,342.44, totaling $1,158,550.50. In addition, approves 260 Payroll Benefits
warrants for draws on pay totaling $229,442.00.
4. Resolution No. 11-342 Approving a lease assignment of a land lot lease at the
South County Airport.
Robert Johnson, Director of Community Development, stated Donald Carlson,
leaseholder of Land Lot #4 at the South County Airport, wishes to assign the lease,
which is authorized under terms of the lease, to Michael Gauger. The Lewis County
Airport Systems Manager has drafted a Lease Assignment and has authorized the
assignment. The Board of County Commissioners has the final authority to approve the
lease assignment. Michael Gauger will assume the conditions and responsibilities of
the original and amended lease, currently in the name of Donald Carlson.
5. Resolution No. 11-343 Approving waiving Public Works and Community
Development fees for the Justin Lane Bridge Project, due to financial
hardships.

Robert Johnson, Director of Community Development, stated the Justin Lane
Bridge washed out during the 2009 Tilton River flood event. The private bridge served
several residences in the area and was the only access. Since the loss of the bridge,
homeowners only have walking access over a log bridge. The homeowners have
considerable financial hardship due to the washing out of the bridge. The bridge will
cost in excess of $200,000, which is, of itself, a financial burden on the effected
homeowners. The homeowners have requested a waiver of all county fees, citing a
considerable financial hardship.
Commissioner Grose stated the homeowners are able to use the bridge now but there
are still things that need to be done. The bridge that washed out was estimated to cost
between $1.5 and $2 million to replace. The timber company that owned the road and
the bridge did not have that much need for it and decided that they were not going to
replace their bridge. The only option the homeowners had was to either have the
County build a bridge, which would have been very expensive, or to build a private
bridge to access the property. From time to time we waive fees in the face of an
emergency. During the 2009 flood we waived a considerable amount of waste disposal
fees for the residents of Lewis County.
6. Resolution No. 11-344 Authorization for Community Development to apply for
grant funding from the Department of Ecology for the mandated update to the
Shoreline Master Program.
Robert Johnson, Director of Public Works, stated the attached resolution will
authorize the Director of the Department of Community Development to apply for
$450,000.00 in grant-funding from the state Department of Ecology to help defray costs
associated with updating the Lewis County Shoreline Master Program. The state
Shoreline Management Act, Chapter 90.58 RCW, requires that the county Shoreline
Master Program be reviewed and updated periodically. Under state law, Lewis County
and the cities within the county subject to the Shoreline Management Act must have
completed the mandated update by December 31, 2013. To accomplish this, the state
offers funding through the Department of Ecology. Lewis County and the cities of
Chehalis, Centralia, Winlock and Morton have agreed to work together to update their
respective master programs, pooling the Ecology grant-funding. By working
cooperatively, and pooling grant funds, the county and cities will be able to hire a
qualified consultant to assist in the necessary technical work and to provide support for
the public outreach as necessary. It is anticipated that Lewis County will receive
$450,000.00 funding; Chehalis and Centralia will each receive $125,000.00; Winlock
and Morton will receive $40,000.00 each. We anticipate having the update done within
six months of the due date because State Law says you have a specific period of time
to update the plan after the funds are available.
7. Resolution No. 11-345 Selection of contractor for the purchase of a Cal-Cert
Company compression testing machine.

Tim Elsea, Director of Public Works, stated many of Public Works construction projects
require compression testing on concrete. During the period between 8/15/2010 and
12/1/2010 WSDOT performed 42 compression tests at $45.06 per test on two bridge
projects, Chandler and Newaukum. Sixteen cylinder cut or caps and three cube
compressions were also required during the same time period at a cost of $45.06 and
$90.11 per test. The total cost of these tests was $2,883.44. All tests except those
requiring independent certified testing could have been performed by Lewis County if we
had the proper equipment. Research was done and we found the equipment needed
would cost between $11,849.00 and $11,918.00. Cal-Cert Company offered Public Works
a refurbished Brainard Kilman Testing Machine, Model C140 for $4,675.00 plus tax of
$316.00 for a total cost of $4,991.00. This testing machine would have been able to
perform the above tests and also has the capability of performing other design and
construction testing. RCW 39.04.280 allows governmental agencies to dispense with
competitive bidding requirements involving special market conditions. Public Works took
advantage of the special market conditions by purchasing the equipment. This equipment
would not have been available at this price due to additional time required in the formal
competitive bidding process. The Board is asked to ratify the decision of the Director of
Public Works to use special market conditions for the purchase of a refurbished Brainard
Kilman Testing Machine, Model C140 from Cal-Cert Company in the amount of
$4,991.00.
8. Resolution No. 11-346 Approving an inter-local with the City of Tacoma,
Department of Public Utilities, Light Division for the use of a boat and operator
for assistance in providing access for debris removal from various bridges.
Tim Elsea, Director of Public Works, stated this Resolution will allow Lewis County
and the City of Tacoma, Department of Public Utilities, Light Division (d.b.a. Tacoma
Power) to enter into an Inter-local Agreement for the use of a boat and operator for
assistance in providing access for debris removal from various bridges in Lewis County.
This Agreement will govern reimbursable work performed by Tacoma Power forces for
which the County has insufficient personnel/equipment to accomplish said work. The
term of the Agreement will be for a period of 5 years and will expire on October 31,
2016.
9. Resolution No. 11-347 Approving a contract amendment with the Division of
Behavioral Health and Recovery Services for an increase in funding for the
Criminal Justice Treatment funds.
Tara Smith, Public Health and Social Services, stated the purpose of this contract
amendment is to increase the Criminal Justice Treatment Account revenue for the
2009-2011 Biennial Contract with the Division of Behavioral Health and Recovery in the
amount of $27,000.00. This will increase the total contract amount to $1,639,366.00 the
total increased was used to pay for treatment services for clients enrolled in drug court.
Funding came from under expenditures from other counties leaving excess funds at the
State level and we were projected to over spend those funds. We had not over spent
them yet so we were able to ask for additional funding.

10. Resolution No. 11-348 Approving Amendment No. 1 to a Professional Service
Agreement with Veteran’s Benefit Specialist, Daniel Henderson, to change the
mileage reimbursement rate.
Danette York, Director of Public Health and Social Services, stated Daniel
Henderson is contracted as a Veterans Benefit Specialist with the objective of providing
services to local indigent veterans and/or their dependents. Mr. Henderson’s current
contract with the County states that his mileage rate will be reimbursed at $.50 per mile.
That was the reimbursement rate at the time the contract was approved. Since the
mileage reimbursement rate changes by resolution approved by the Board of County
Commissioners, it is necessary to tie the amount Mr. Henderson receives to the current
amount approved by resolution.

There being no further business, the Commissioners’ public meeting adjourned at 10:36
am on October 24, 2011. The next public meeting will be held Monday, October 31,
2011, at 10:00 a.m.
