2011-12-05 Board Meeting Minutes 1 BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON BOARD MEETING MINUTES December 5, 2011 The Board of County Commissioners for Lewis County, Washington met in regular session on Monday, December 05, 2011 at 10:00 a.m. Commissioners Ron Averill, Bill Schulte, and F. Lee Grose were in attendance. Chairman Averill determined a quorum, called the meeting to order and proceeded with the flag salute. Commissioner Grose moved to approve the minutes from the 10:00 a.m. meeting held on Monday, November 28, 2011. Commissioner Schulte seconded the motion. Motion Carried 3-0 NOTICE Commissioner Schulte moved to approve Notice Agenda items one through three. Commissioner Grose seconded the motion. Candace Hallom read the items into the record. 1. Notice of Hearing: Regarding the adoption of the 2012 Vader Water System Final Budget. Hearing will be held on or after 10:00 am, on Monday, December 19, 2011. Resolution No. 11-406 Dawna Truman, Budget Director, stated this Resolution sets a hearing date for December 19, 2011. The notice will be published on December 7th and 14th in The East County Journal and on December 8th and 15th in The Chronicle. Notice is given that the Board of County Commissioners will meet on Monday December 19, 2011 on or after 10:00 am for a public hearing at which any taxpayer may appear or be heard for or against any part of the 2012 Vader Water System budget. Copies of the budget will be available in the budget/fiscal office after January 31, 2012. 2. Notice of Hearing: Regarding the 3rd 2011 Budget Amendment for Current Expense and Various Funds. Hearing will be held on or after 10:00 am, on Monday, December 19, 2011. Resolution No. 11-407 Dawna Truman, Budget Director, stated this notice is in regard to a notice of hearing for the 3rd 2011 budget amendment for current expense and various funds in the amount of $1,411,357.00 with an offset revenue of $572,656.00 and use of the fund balance in the amount of $838,701.00. Hearing date is set for December 19, 2011. The notice will be published on December 7th and 14th in The East County Journal and on December 8th and 15th in The Chronicle. 3. Notice of Hearing: Regarding Ordinance 1235 amending Chapter 9.10-030 adding a new subsection to provide an exemption for ammunition testing at an authorized manufacturing facility. Hearing will be held on or after 10:00 am, on Monday, December 19, 2011. Resolution No. 11-408 2 Robert Johnson, Director of Community Development, stated this notice will be published in The East County Journal on December 7, 2011 and a hearing will be held on December 19, 2011 on or after 10:00 am. Under existing County Code Chapter 9.10.030, discharge of a firearm is prohibited within a “no shooting zone”. Exemptions allow discharge under certain conditions. No exemption currently exists for lawfully operating ammunition manufacturing facilities. Testing is not allowed in “no shooting” zones. The proposed ordinance would provide an exemption, allowing the discharge and testing of ammunition by an authorized manufacturer in facilities designed for such testing. Chairman Averill stated the Silver State Armory, an ammunition manufacturing firm operating in Packwood at the East Lewis County Public Development Authority, is located in a Lewis County designated “No-Shooting Zone (NSZ).” There is a need to test ammunition they are producing at an outdoor range and the current LCC does not provide an exemption for this activity in a NSZ. Motion Carried 3-0 CONSENT Commissioner Grose moved to approve Consent Agenda items four through seven. Commissioner Schulte seconded the motion. Candace Hallom read the items into the record. 4. Resolution No. 11-409 Approval of warrants and payroll for payment. Chairman Averill stated this approves 1 Special Purpose warrant (Vader Water System) for $70.00 and 237 warrants issued by the Auditor’s Office for $684,794.48, totaling $684,864.48. Also approves 432 automatic deposit checks totaling $1,169,654.36; and, 146 payroll warrants for net pay, and 62 payroll warrants for benefits/deductions for a total $3,063,153.62. 5. Resolution No. 11-410 Approving an inter-governmental cooperative purchasing agreement with the Department of Enterprise Services. Chairman Averill stated this approves an Inter-governmental cooperative purchasing agreement between Lewis County and the Washington State Department of Enterprise Services. The agreement will allow Lewis County departments to purchase a variety of products and services from the State at a significantly lower rate. The agreement is for one year ending December 31, 2012 at a cost of $3,000.00. 6. Resolution No. 11-411 Ratification of amendment No. 5 to the Coordinated Prevention Grant with the WA State Department of Ecology. Steve Skinner, Solid Waste, stated the Washington Stated Department of Ecology has offered an amendment to its Coordinated Prevention Grant (CPG) Agreement No. 3 G1000 500, a 2-year contract with the Lewis County Solid Waste Utility, which increases the maximum eligible cost for the agreement by $88,343.00, allowing the Solid Waste Utility to receive reimbursement for acceptable moderate risk waste and recycling activities through December 31, 2011. The total grant agreement agreed upon in January 2010 was $161,016.00. Amendment No. 3 agreed upon in April, increases the total grant agreement to $323,832.00. The State’s share of the $88,343.00 increase is $66,257.25 and the Solid Waste Utility’s share is $22,085.75. The Solid Waste Utility Fund 401 budget for 2011 provides for state grant funding. The amendment grants an increase to the original amount awarded in January 2010 and therefore, requires BOCC approval. 7. Resolution No. 11-412 Reappointing members to the Lewis County Planning Commission for four year terms. Robert Johnson, Director of Community Development, stated that both Mr. Tausch and Mr. Guenther are currently serving their second term on the Planning Commission. Their terms will expire on December 31, 2011. Each has expressed interest in being re- appointed to an additional term. This resolution would reappoint them to an additional four-year term. Motion Carried 3-0 HEARING Hearing: Amendments to the LC Comprehensive Plan and Ordinance 1228, Amending Title 17 of the Lewis County Code. Chairman Averill announced the hearing and asked for a staff report. Robert Johnson, Director of Community Development, explained the process of this hearing and referred to maps showing options provided by the Planning Commission. He stated the County has been considering Subarea Planning for about two years. That plan will be considered on December 12, 2011 at a notice of public hearing. The plan does not appear ready to be adopted but will be heard due to being noticed. The Department of Commerce suggested in lieu of adopting the South County Subarea plan that we adopt some policies and adopt what is called an Urban Reserve Overlay District to preserve the zoning that exists in two areas of the South County. Jerry Basler, Community Development, stated the two properties are located on the southeast, for a total of 25 acres. He met with property owners that had previously sent letters, phone calls, or emails objecting to being included in the South County Plan. They explained to the property owners what it meant to be in or out. Ultimately, these two property owners wanted to be included in the South County Plan. Chairman Averill state this was originally proposed as an Urban Growth Area which got a considerable amount of attention. He asked what the difference was between an Urban Growth Area and an Urban Reserve? 4 Jerry Basler stated an economic Urban Growth Area is established under GMA and requires utilities to be provided. An Urban Reserve Overlay District is not under GMA and they don’t have to go under the same vetting processes as you do with GMA. It is a place holder. There are four properties that would be affected by the 20 acre minimums if they choose to subdivide. Commissioner Schulte asked what is the difference in not calling it anything rather than an Urban Reserve? Robert Johnson stated the biggest difference would be the inability to develop your property at the maximum density allowed. Chairman Averill asked if there were any more questions. There were none. He closed the question and answer portion of the hearing and opened the formal hearing. Robert Johnson and Jerry Basler asked that their previous comments be adopted into the record. Rick Haddock, landowner, stated he has been actively participating in how the South County Plan has been progressing. He stated he is in favor of what is being proposed. In this type of environment with the Growth Management planning process you have to take baby steps and this is one of many baby steps that are going to have to be done. He stated it is difficult to plan for a future development site without knowing what the ultimate zoning will be and what the uses within the zone might be. He suggested through this process that a more formalized idea of going through an Urban Holding Area which would be designated on the comprehensive plan as a future zoning designation. The Urban Holding Area gives a property owner or potential developer a path of how to get from point a to b. Chairman Averill asked if there were any other statements for public testimony. There were none. He closed the hearing. There will not be any decision today. This Ordinance will be part of the Growth Management Development Regulations that we will look at next week. Hearing: • Adopting the 2012 Budget • Establishing the property tax budget for the general levy and road levy, as well as a property tax shift for 2012. • Joint Resolution of the City of Chehalis and Lewis County to approve the 2012 budget for the Chehalis/Centralia Airport. Chairman Averill announced the hearing and asked for a staff report. 5 Dawna Truman, Budget Director, stated The Board of County Commissioners will meet in regular session on the first Monday in December, 2011, pursuant to public notice as provided by law, for the purpose of adopting the budget for the year 2012, compiled on 2011 valuation as assessed by the Lewis County Assessor. RCW Chapter 36.40 provides requirements for the adoption of preliminary and final budgets for counties; the Board has conducted various public hearings, meetings, and work sessions to consider the 2012 annual budget for Lewis County. Dawna summarized the 2012 budget; Current Expense $33,335,461.00 Budgeted and Non-appropriated $152,440,072.00 Special Revenue Funds $42,767,001.00 Debt Service Funds $2,085,515.00 Capital Funds $2,996,240.00 Proprietor fund include 400 funds $8,526,975.00 Internal Service Funds $10,659,104.00 Agency Funds $1,443,141.00 Revenue $95,362,256.00 Total Expenditures $101,813,437.00 Current Expense budget is balanced with the use of fund balance in the amount of $715,409.00 Salary’s and Benefits $22,227,513.00 Other Funds $68,477,976.00 Dawna Truman stated regarding establishing the property tax budget for the general levy and road levy, as well as a property tax shift of $17,000.00 for 2012. Lewis County’s regular levy budget would be set at $11,500,000.00 which is a levy decrease of $830,028.16 or 6.89% over the previous year levy. The County Road District levy budget would be $11,400,000.00 which is an increase of $1,260,176.39 or 12.85% over the previous year levy. A shift in the County Road Fund levy to the Current Expense Fund is allowed by RCW 84.52.043; the shift from the County Road Fund levy does not reduce the levy capacity of any other taxing districts. The revenue shift from the County Road Fund to Current Expense will be $17,000.00 for a Social Services DUI program. These changes are mainly due to the $1 million road shift for 2011 and a $17,000.00 road shift in 2012 to support DUI. Allyn Roe, Airport Manager, explained the 2012 budget for Chehalis Centralia Airport. He stated there is $1,470,055.00 in revenue and all but $100,000.00 is earned income. He stated capital expense is budgeted in the amount of $416,205.00 and operating expenditures in the amount of $1,026,936.00. Dawna Truman stated the Airport Advisory Board proposed this budget on November 16, 2011 and the City of Chehalis plans to adopt it on December 12, 2011. Chairman Averill asked if there were any more questions. There were none. Chairman Averill stated this is a very long process that County Commissioners have to go through. We have had very good cooperation in the last two budget cycles with the other elected officials. We have a recession that has lasted much longer than normal recession periods. We have had a couple of things that have happened this year that has helped out. He gave kudos to the budget and fiscal staff, to the Auditor's office in helping us get to where we are, and to all of our elected officials. We are one of the few counties who continue to operate in the black. Chairman Averill asked if there were any other statements for public testimony. There were none. He closed the hearing and asked for a motion. Commissioner Schulte made a motion to approve the three budget Resolutions. Commissioner Grose seconded the motion. Candace Hallom read the item into the record Resolution No. 11-413 Adopting the Annual Budget of Lewis County For the Calendar Year of 2012. Resolution No. 11-414 Property Tax Levy for Both the Current Expense and Road Fund as Well as a Property Tax Levy Shift for 2012. Resolution No. 11-415 A Joint Resolution of the City of Chehalis and Lewis County to Approve the 2012 Adopted Budget for the Chehalis Centralia Airport. Motion Carried 3-0 There being no further business, the Commissioners’ public meeting adjourned at 11:30 am on December 5, 2011.
