2010-07-19 Board Meeting Minutes 1 BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON BOARD MEETING MINUTES July 19, 2010 The Board of County Commissioners for Lewis County, Washington met in regular session on Monday, July 19, 2010, at 10:00 a.m. COMMISSIONERS P.W. SCHULTE, RON AVERILL and F. LEE GROSE were in attendance. Chairman Schulte determined a quorum, called the meeting to order and proceeded with the flag salute. Commissioner Grose moved to approve the minutes from the 10:00 a.m. meeting held on Monday, July 12, 2010. Commissioner Averill seconded the motion. Motion carried 3-0 NOTICE Commissioner Averill made a motion to approve Notice Item one. Commissioner Grose seconded the motion. Karri Muir, Clerk of the Board, read the item into the record. 1. Notice of Acceptance: For the Lewis County Low Cost Run Off Road Safety Improvement Project. Resolution 10-178 Rod Lakey, Public Works, stated Lewis County is in receipt of all closeout documentation and Public Works has certified the completion of the contracted work. It appears the work meets the contractual obligations of the project specifications and drawings. Public Works recommends that the BOCC of Lewis County, accept the project and issue a Certificate of Completion for the Lewis County Low Cost Run Off Road Safety Improvement Project, CRP 2142. Motion carried 3-0 CONSENT Commissioner Grose made a motion to approve Consent Items two through seven. Commissioner Averill seconded the motion. Karri Muir, Clerk of the Board read the items into the record. 2. Resolution No. 10-179 Approving a contract with Lewis County Shelter Program. Danette York, Health, stated the Lewis County Shelter Program has provided transitional housing to 58 homeless families since May 1, 2002. Homeless is defined by HUD as: staying in a shelter, in a vehicle, or on the streets. Families are defined as a parent/parents with a minor child or children. This contract extends the current 2 McKinney program for the fiscal year May 1, 2010 to April 30, 2011. Nine families will be placed in scattered site leased single-family houses and apartments. Grant funds will be used to lease properties, operate the housing and pay the salary of one full-time equivalent position providing outreach and case management services. The total amount of this grant is $106,272.00 Commissioner Averill asked Ms. York to look into a letter the BOCC received from LC Shelter Program, regarding funding cuts. Ms. York stated that she would look into the letter. She also explained that the LC Shelter Program funding was decreased. The total overall funding for homeless funding stated the same. The Housing Committee decided to lower the funding for the LC Shelter Program. 3. Resolution No. 10-180 Approving contracts for chemical dependency treatment with Providence Addiction Recovery Center, Eugenia Center, True North Student Assistance, and Fresh Start. Danette York, Health, stated the Division of Behavioral Health and Recovery Services has contracted with Washington counties to coordinate, sub-contract, and administer chemical dependency treatment, prevention, and ancillary services. This is a cost related contract with the exception of the administrative allowance. Lewis County has historically sub-contracted prevention, intervention, and treatment services to agencies operating in the county. These sub-contracts are reimbursed on a cost-related basis. Lewis County receives funding from the Division of Behavioral Health and Recovery Services to fund local chemical dependency treatment services. Lewis County contracts with local treatment providers for these services and has contracts with Providence Centralia Recovery Center, Eugenia Center, True North, and Fresh Start. The contract from the Division of Behavioral Health and Recovery was not received until November 2009 and was processed and signed by the BOCC in December. The contracts were sent to providers in January and February of 2010 with the last contract being returned in April. The funding for these contracts is from the Division of Behavior Health and Recovery for the 2009-2010 year. Resolution No. 10-181 Contract with Cowlitz-Wahkiakum Council of Governments for Transportation planning costs and work performed. Tim Elsea, Public Works, stated this contract between Cowlitz-Wahkiakum Council of Governments and Lewis County is provided to support a Transportation Planner for 2010 – 2011. The Planner will support Lewis County and the Lewis County Transportation Coalition in developing comprehensive transportation solutions and to assist in prioritizing and programming transportation infrastructure within the County and developing regional infrastructure improvements. This work will support the delivery of the Products/Outcomes as defined in the Lewis County Transportation Strategy Council Charter including travel demand forecasting and traffic modeling of the regional, county, and local city roadway systems. The purpose of this work is to develop long-range regional transportation improvements to meet future land use and growth to an acceptable level of service within Lewis County. The term of the agreement is July 1, 2010 through June 30, 2011. The maximum amount payable under this contract is $25,000. Commissioner Grose noted that this funding came about when Lewis County no longer wanted the Cowlitz-Wahkiakum Council of Governments (COG) locally to maintain an office. The COG agreed to pay Lewis County $25,000.00 for transportation planning by the new Transportation Strategy Council. 5. Resolution No. 10-182 Bid award for the Pe Ell McDonald Rehabilitation Project. Rod Lakey, Public Works, stated this project is listed as number four on Lewis County’s 2010 amended Six Year Transportation Improvement Program. The contract will provide for the improvement of 2.9 miles of Pe Ell McDonald Road in Lewis County by treating the base with cement, adding crushed surfacing base and top course, planing, applying tack coat, hot mix asphalt overlays, approach transitions, shoulder finishing, placing pavement markers, installing flexible guide posts, traffic control, constructing culverts, constructing rock walls, placing guardrail, and other work. The contract price of $1,265,084.83 was provided by the lowest responsive bidder, Rognlin’s Inc. of Aberdeen, Washington. This project was funded through 4 FHWA. The Federal participation for this project for the construction phase is 86.5%. Lewis County is responsible for the remaining 13.5%. 6. Resolution No. 10-183 Bid award for the Hadaller Road Slide Repair Project. Rod Lakey, Public Works stated this project is listed as number nine on Lewis County’s 2010 amended Six Year Transportation Improvement Program. The contract will provide for the improvement of 0.07 miles of Hadaller Road in Lewis County by constructing a Gravity Block Wall, culverts, ditches, placing Large Woody Debris, placing Rip Rap, placing guardrail, paving with Hot Mix Asphalt, placing shoulder rock, and other work. This project was funded through the FEMA Public Assistance Program. Emergency repairs were conducted for public safety. The contract price of $197,487.84 was provided by the lowest responsive bidder, Fuchs Bros. Inc. of Mossyrock, Washington. The Federal participation for this project is anticipated for the construction phase at 75%, therefore the State and Lewis County are responsible for the remaining 25% equally. Mr. Lakey also noted that both of these projects have an August 16, 2010 start date. 7. Resolution No. 10-184 Approving an easement and an agreement with Energy Northwest. Larry Unzelman, Public Works, stated Lewis County plans to make improvements to the Packwood Airport that will require crossing property owned by Energy Northwest adjacent to the south end of the airport. Energy Northwest has agreed to an easement and an agreement allowing the improvements on their property. The attached resolution would approve both the easement and the agreement between Energy Northwest and Lewis County to improve and maintain a runway safety area and an airport runway extension for the Packwood Airport. Energy Northwest has executed the agreement and easement. The easement will be recorded once signed by the County Commissioner Averill stated this is another project that has been worked on for several years. It is one that is very important to the County. Motion carried 3-0 Hearing Hearing Franchise to NOANET Chairman Schulte announced the hearing and asked staff for a report. Larry Unzleman, Public Works, stated NOANET has applied for a License to renew their rights to occupy a portion of Highway 603 right of way west of Napavine. NoaNet is a Mutual Non Profit Corporation incorporated in the State of Washington. The Corporation was formed through relationship and funding from Public Utility districts in the State of Washington, with Lewis County PUD being a founding funder of the Corporation. 5 NoaNet represents Public Utility Districts that have linked their fiber optic networks together to achieve economic feasibility in underserved areas. NoaNet is unique in working with customers as a partner to present a complete end-to-end solution, which can include more than telecommunications. NoaNet’s mission is to provide low cost, advanced telecommunication and data services to rural counties in the Northwest. This mission is driven by the history of commercial, for profit telecommunications companies building fiber optic networks through rural counties without providing “off-ramps” to their networks. Through NoaNet, wholesale providers such as cable companies gain total access to the rural Northwest to serve major enterprises and government entities that require significant bandwidth to achieve future growth. The network parallels the BPA transmission line system and uses fiber supplied by BPA as well as by others. Resolution 10-155, passed by the BOCC on June 21, 2010, set July 19, 2010 as the date for hearing on the matter of granting a License for telecommunications facilities on Highway 603 Right of Way. The License is for a five-year term. RCW 36.55 requires that no hearing be held on a proposed License until five days after the last publication date, and 15 days after posting of the notice thereof in three public places. Publication must be twice in the official newspaper for publication in the County. Publication occurred on June 23, 2010 and June 30, 2010, and the notice of hearing was posted in three public places. The Licensee has reviewed, agreed to and signed the License. Commissioner Averill asked if the approximate location of the franchise was near the power substation on Hwy 603 and if the fiber was going under the road. Mr. Unzelman stated it is near that location and the fiber will go across the road. Chairman Schulte closed the question and answer portion of the hearing and opened the formal hearing. Mr. Unzelman asked that his previous comments be adopted into the record. Chairman Schulte closed the hearing and asked for a motion to approve Resolution No. 10-185. Commissioner Averill moved to approve Resolution No. 10-185. Commissioner Grose seconded the motion. Karri Muir, Clerk of the Board, read the item into the record. Motion carried 3-0 There being no further business, the Commissioners’ public meeting adjourned at 10:35 a.m. on July 19, 2010.
