2010-11-08 Board Meeting Minutes 1 BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON BOARD MEETING MINUTES November 8, 2010 The Board of County Commissioners for Lewis County, Washington met in regular session on Monday, November 8, 2010, at 10:00 a.m. COMMISSIONERS P.W. SCHULTE, RON AVERILL and F. LEE GROSE were in attendance. Chairman Schulte determined a quorum, called the meeting to order and proceeded with the flag salute. Commissioner Averill moved to approve the minutes from the 10:00 a.m. meeting held on Monday, November 1, 2010. Commissioner Grose seconded the motion. Motion carried 3-0 PUBLIC COMMENT Commissioner Averill stated this is the week of Armed Forces Day which is a holiday on the 11th day of November. There are a number of events that are going on Thursday, November 11th: at 10:00 am American Legion Post 17 will hold its annual Veterans Day Recognition Ceremony at Washington Park; and, again that evening at the Church of Jesus Christ Latter-day Saints on Market Blvd. in Chehalis, they will have a Navy band and other groups recognizing Veterans at the Church; for Veterans, Applebee’s is providing a free meal; and the Lewis County Veterans Museum, which is one of the best private Military Museums in Washington, after the American Legion Ceremony, will be open and the USO will be open to welcome Veterans to go through the museum. It is a time when we can honor those who have served in the Military and have sacrificed for our freedom. NOTICE Commissioner Grose made a motion to approve Notice Agenda items one and two. Commissioner Averill seconded the motion. Candace Hallom read the items into the record. 1. Notice of Hearing: Regarding a budget amendment for the Vader Water System Improvement capital fund and operation fund. Hearing will be held on or after 10:00 am, on November 22, 2010. Resolution No. 10-280 Dawna Truman, Budget Office, stated this is a request for approval to publish a Notice of Hearing regarding a 2010 Budget Amendment. The two amendments will be for the Vader Water System Improvement Capital Fund and the Vader Water System Operations Fund. The total of the amendments are expected to be $42,500.00. Notification will be published in The East County Journal on November 10 and 17, 2010 and the hearing will be set for November 22, 2010. 2 Commissioner Averill stated it is official, the Court met on October 29, 2010 and receivership was granted to Lewis County. Our Public Works and Budget/Fiscal Departments are working toward putting all of the things in place that are needed to run that system. We are currently working with the City of Vader toward a January 1, 2011 establishment date. Commissioner Grose stated this is new territory for the County and there are bound to be some bugs. Hopefully we can make this as smooth a transition as possible. Please bear with us and let us know if things are not going as well as we might expect. 2. Notice of Hearing: Regarding a non-exclusive franchise to Mashell Telecom, Inc., DBA Rainier Connect, to construct, operate, and maintain telecommunications facilities on County right of ways. Resolution No. 10-281 Larry Unzelman, Public Works, stated Mashell Telecom, Inc., dba Rainier Connect, has requested a non-exclusive franchise for the construction, operation, and maintenance of telecommunications facilities on various Lewis County roads. The franchise in general covers roads in the Centralia, Chehalis, Adna, Napavine, and Winlock areas. They have a franchise in place which expires on January 8, 2011. This franchise will authorize the continued use of the road rights of way for 5 years for the above stated purpose. This resolution will set December 6, 2010 as the date for hearing on the franchise and call for required postings and publications by RCW 36.55.040. Commissioner Averill stated he presumes this is predominantly a cable that they string on our power lines for their fiber optics. Larry stated that is correct. Commissioner Grose stated there was some discussion last week at the Risk Pool meeting regarding rights of way amenities and the legal liability that we have if we don’t have these in place. There is some liability if we don’t have right of ways established so it is important that we get these out there. Motion carried 3-0 CONSENT Commissioner Averill made a motion to approve Consent Agenda items three through seven. Commissioner Grose seconded the motion. Candace Hallom read the items into the record. 3. Resolution No. 10-282 Approval of warrants and payroll for payment. 3 Commissioner Averill stated this resolution approves 229 warrants issued by the Auditor’s Office for a total of $659,373.91. Also, approves 427 automatic deposits, 161 warrants for County Net Pay, and 57 warrants for County Benefits & Employee Deductions for a total of $3,053,949.56. 4. Resolution No. 10-283 Proposed acquisition of right of way for Coughlin Road Bridge. Larry Unzelman, Public Works, stated Lewis County’s Six Year Transportation Improvement Program includes the Coughlin Road Bridge Repair Project, located east of Onalaska. This project involves truss repair, scour repair and deck replacement. The project will require right of way acquisitions from two property owners. The attached resolution would grant authority to the Public Works Department to acquire the necessary additional right of way. Procedures for acquiring necessary right of way, adopted by Resolution 09-381, will be followed in this process. Commissioner Averill asked, if you are successful in negotiating these rights of ways, will you be back with us for approval of items? Larry Unzelman stated this would approve the acquisition unless we had to do an administrative offer. If we have to go above fair market value it would require the Boards approval. 5. Resolution No. 10-284 Approving an inter-local with Lewis County Conservation District concerning aid and assistance. Robert Johnson, Community Development, state the Conservation District is a special purpose district set up under the State Law for the purpose of protecting and improving the quality of surface and ground water, watershed planning and implementation, riparian reforestation and enhancement, forest stewardship, wildlife habitat enhancement, salmon recovery, conservation education, and preservation of prime farmlands. Historically, the County has provided direct assistance to the Conservation District, however, given the current economy there is no money available. At this time, there is no direct assistance being provided through the 2011 budget but this agreement spells out the extent and conditions under which aid may be provided to the Conservation District by the County, including potential funding and assistance in obtaining funding. Commissioner Averill stated the County had been giving assistance to the Soil Conservation service in Lewis County. Twenty years ago the County allowed an employee of the County to work over at the Conservation Service. Over the twenty years, that employee disappeared and money appeared in the Conservation District budget without any agreements being made between the Conservation District and the County. The Soil Conservation Service does 4 receive State and Federal Funding and has a provision where they can collect local funds. We are required to have an agreement with the Conservation District and this resolution establishes that agreement. 6. Resolution No. 10-285 Approving a casual on-call Public Health Nurse II for the Public Health and Social Services Department. Danette York, Public Health and Social Services, stated this resolution establishes a casual on-call Public Health Nurse II for our Public Health and Social Services Department. This position is to provide aid and services for our immunization clinics as needed and to help with our specific projects. Commissioner Averill stated we have had to make cuts in the budget and are starting to see the impact of that. We cut back the Department so there was only one nurse providing immunizations. W hen she wants to take leave we need to have a back-up. We do have some stimulus funding that allows us to provide this contingency. 7. Resolution No. 10-286 Cancellation of warrants. Commissioner Averill stated this resolution approves cancellation and reissue of Lewis County Auditor warrants. One warrant for $2,000.00 was a duplicate warrant and another for $90.00 is a stale dated warrant. Both are cancelled. Five warrants for a total of $208.77 are stale dated warrants and will be cancelled and reissued to the vendors. Motion carried 3-0 There being no further business, the Commissioners’ public meeting adjourned at 10:20 a.m. on November 8, 2010.
